98 Dashiell by his attorney afd and the sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P me Joseph Macclester Sherr Whereupon the said Robert Boyer appers and at the prayer of the plfts attorney the said Robert Boyer is adjudged to give a speciall Bail to the action afd Thereupon a Certain James Ward of Somersett County Planter present here in Court undertakes for the said Robert Boyer that in Case the said Thomas Dasheill shall recover Judgm.t in the plea afd against the said Robert Boyer or that the said Robert Boyer shall be therein Convict that then he the said Robert Boyer shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr ^of Somersett County^ in satisfaction thereof or that he the said James Ward will do it for him Whereupon the said Robert Boyer in his Own proper person Comes and defends the force and Injury when &c and says that he Cannot Gainsay the plft his action afd so as afd against him Brought nor Can he say but that the said Plft Ought to recover his damages by occasion of the premisses afd to the sume of five hundred and seventy four pounds of tobacco and Costs of Suite against him which the said plft doth not gainsay &c Therefore it is Considered by the Justices here the twentieth day of august ann Dom One thousand seven hundred and twenty three afd that the said Thomas Dasheill recover against the said Robert Boyer as well the sume of five hundred and seventy four pounds of tobacco Certain damages afd in form afd Confesed as also the (294) sume of Two hundred & Ninty four pounds of tobacco by the Court here adjudged unto him for his Costs and by him about his suite in this Behalfe Laid Out and Expended and the deft in mercy &c
held at Dividing Creek in Somersett County afd the third tuesday of August then next to answer unto Thomas Dasheill of a plea of trespass upon the Case and that thereof he should not fail &c And the said Thomas Dashiell by George Dashiell his attorney declared against the said John Bredy adm.r as afd in the plea afd as followeth viz.t Somersett County fs John Bredy of Stepney Parish admr of all and singular the goods and Chattles of James Bredy late of the said Parish decd was attached to answer unto Thomas Thomas Dasheill of a plea of trespass upon the Case &c And whereupon the said Thomas Dashiell P George Dashiell his attorney Complaines that whereas the said James in the year of Our Lord God One thousand seven hundred and Eighteen at Stepney Parish in the County afd within the Jurisdiction of this Court was Indebted unto the said Thomas in the sume of four hundred and seventy pounds of tobacco as P account here unto annexed may in Court appear and being Indebted as afd for and in Consideration afd at the time and place afd did upon himselfe assume and to the said Thomas then and there did faithfully promise that the sume of four hundred and ^seventy^ pounds of tobacco he would pay and Content when he should be thereunto requested Nevertheless the said James in his Lifetime the sume afd did not pay nor the said John in his Capacity since his decease altho' often (thereunto) |
