99 thereunto Requested but the same to pay hath refused and still doth refuse to the damage of The said Thomas of nine hundred and forty pounds of tobacco and thereupon his Brings this Suite
the holy Evangelist that the above acc.t is Just and that he hath given due Creditt & that there rest due four hundred and seventy pounds of tob.o is Just and true tot eh best of his Knowledge Test W.m Stoughton Att which said third tuesday of august to witt the twentieth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Thomas Dasheill by his attorney afd and the Sherr of Somersett County to whom the foregoing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus P me Jos: MccClester Sherr Whereupon the said John Bredy administrator as afd in his Own proper person Comes and defends the force and Injury when &.c and saith that he Cannot gainsay the plft his action afd so as afd against him Brought Nor Can he say but that the said Plft Ought to recover his damages by occasion of the premisses afd to the sume of four hundred and seventy pounds of tobacco and Costs of Suite to be Levied of the goods and Chattles which were of the said James Bredy at the time of his death which to his hands hereafter shall Come to be administred which the said plft doth not gainsay &.c Therefore it is Considered by the Justices here the twentieth day of august ann Dom one thousand seven hundred and twenty three that the said Thomas Dashiell recover against the said John Bredy administrator of the afd James Bredy dec.d as well the sume of four hundred and seventy pounds (245) of tobacco Certain damages afd in form afd Confesed as also the sume of Two hundred & forty five pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out & Expended to be Levied on the goods and Chattles which were of the said James Bredy at the time of his death and which to the hands of the said John Bredy adm.r as afd hereafter Shall Come to be administred and ye Deft in mercy &.c
in the County Court of Somersett on the twenty second day of march in the fifth year of Our Dominion &.c ann Dom One thousand seven hundred and twenty before the Worshipfull Charles Ballard Gentl and his associates Justices of Our Said Court at Dividing Creek and by Consideration of Our Said Court Recovered against a Certain (Edward) |
