 Command was given to the Sherr of Somersett County that he Should take Robert

Boyer late of Coventry Parish in the County afd Planter if he should be found in y his
                                     Bailiwick and him should Safe Keep so that he might have his Body Before the Justices
       of Our ^his Lordships^ County Court to be held at Dividing Creek in Somersett County afd the third tuesday of august
       then next to answer unto Thomas Dasheill of a plea of trespass upon the Case &c and that thereof he should
       not fail &c       and the said Thomas Dasheill by Levin Gale his attorney declared against the
       said Robert Boyer in the plea afd as followeth viz.t   Somersett County fs.t  Robert Boyer late
       of Coventry Parish in the County afd Planter was attached to answer unto Thomas Dasheill of a plea
       of trespass upon the Case &c    And whereupon the said Thomas by Levin Gale his attorney Complaines
       that whereas the afd Robert the tenth day of may One thousand seven hundred and twenty three at the
       parish afd with in the Jurisdiction of this Court was Indebted unto the afd Thomas the sum of five hundred
       and seventy four pounds of tobacco for Sherriffs dues Levies &c and forbearance thereupon as by acco.t
       therewith in Court produced may more fully appear and so thereof being Indebted the said Robert
       in Consideration thereof afterwards viz.t the day and year afd at the Place afd within the afd
       Jurisdiction upon himselfe assumed and to the said Thomas then and there faithfully promised that
       he when afterwards he should be thereunto requested the afd sum of five hundred and seventy four
       pounds of tobacco to the said Thomas would well and faithfully Content and pay Nevertheless the
       the afd Robert his promise and assumption afd in form afd made Little regarding but plotting and
       fraudulently Intending the afd Thomas in that part to defraud and deceive the afd sum of five hundred
       and seventy four pounds of tobacco to the afd Thomas (altho' the said robert was thereunto
       Requested the tenth day of June One thousand seven hundred and twenty three hath not paid nor
       him for it in any wise Contented but the said Robert the same to Thomas hitherto to pay or him
       for it in any wise to Content hath altogether refused and still doth refuse whereby the said Thomas
       says he is the worse and hath damage to the value of Eleven hundred forty Eight pounds of tobacco
       and thereof he Brings this suite &c    Levin Gale P Quer Pledges &c Jno Doe R Roe
