97 of good sound merchantable Leafe tobacco the which from her he unjustly detaines &c according to Law and that by good and Lawfull men of your Bailiwick you make Known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before the Justices of our said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands Ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make Known unto Our said Justices at the day and place afd and have you then and there this Writt Wittness Charles Ballard Gentl Cheif Justice of Our Said Court the nineteenth day of June in the Eighth Year of Our Dominion &c ann Dom 1723 (F Allen) Thomas Hayward Clk Att which said third tuesday of August to witt the twentieth day of the same month ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Comes the said Margarett Lady Baltemore Exrx as afd by her attorney afd the sher of Somersett County to whom the foregoeing Writt was directed Likewise Comes and makes return thereof Endorst in these words following viz.t By vertue of the within Writt to me directed to the Justices within Mentioned I Certifie that I have attached as the goods Chattles rights & Creditts of the Within Named James Trail son and heir of William Trail late of Somersett County dec.d fifteen hundred pounds of tobacco in the hands of William Lane of SOmersett County to satisfie unto the within Named Margtt Lady Baltemore Exrx as within Contained her debt and Costs recovered against the said James Trail son & heir as afd and further I Certifie that I have given Notice to the said William Lane that he be and appear at the time and place within Contained to Shew Cause if any he have why the same should not be Condemned in his hands for the use of the Said Margarett Lady Baltemore &c before Mathew Hopkins and John Doe good and Lawfull men of my Bailiwick as by the Within Writt I am Commanded so answers Jos: MccClester sher Whereupon the said William Lane ^Garnishee of the afd James Trail son & heir as afd^ altho' solemnly Called to shew Cause why &c Comes not but makes default nor doe any Other person appear for him to shew Cause to the Contrary &c Whereupon the said Margarett Lady Baltemore Exrx as afd by her attorney afd prays that the afd sume of fifteen hundred pounds of tobacco so as afd attached in the hands of the afd William Lane as of the rights and Creditts of the said James Trail son and heir as afd may be Condemned in the hands of the said William Lane towards satisfying unto the said Margarett Lady Baltemore Exrx as afd as well her Debt and Costs against him recovered as all Costs upon this writt of attachmt Therefore it is Considered by the Justices here the twentieth day of august ann Dom One thousand seven hundred and twenty three afd that the said sume of fifteen hundred pounds of tob.o so as afd attached be Condemned in the hands of the said William Lane as of the rights and Credits of the said James Trail son and heir of the afd William Trail &c towards satisfying unto the said Margarett Lady Baltemore Exrx as afd as well the Debt & Costs recovered against him as al Costs accrueing upon the writt of attachm.t afd and that the said Marg.tt Lady Baltemore Exrx as afd have thereof her Execution against the said William Lane according to act of assembly &c |
