97 therefore it is Considered by the Justices here the twentieth day of august ann Dom One thousand seven hundred and twenty three afd that the said Benjamin Wailes have his Execution against the said William Denston for as well the sume of four hundred and Ninety pounds of tobacco his debt afd as also the sume of three hundred and sixteen pounds of tobacco Costs of Suite in the Judgm.t afd specfifyed as (226) Cost also the sume of Two hundred and twenty Six pounds of tobacco by the Court here adjudged unto him for his Costs and damages sustained by occasion of delay of Execution of the Judgm.t afd &c
at the prayer of the plft by his attorney is adjudged to give Speciall Bail to the action afd thereupon a Certain Thomas Fletcher of Somersett County Gentl present here in Court undertakes for the said Henry Courtman that in Case the said Ryves Holt shall recover Judgm.t in the plea afd against the said Henry Courtman or that the said Henry Courtman shall be therein Convict that then he the said Henry Courtman shall pay the Condemnation of the Court thereupon or render his Body unto the Costody of the sherr of Somersett County in Satisfaction thereof or that he the said Thomas Fletcher well due it for him thereupon the said Henry Courtman by Levin Gale his attorney appears & Imparles &c
attach any the goods Chattles rights or Creditts of James Trail son and heir of William Trail late of Somersett County in the province of maryland Clk dec.d if they shall be found in your Bailiwick to the value of fifteen hundred pounds of tobacco and when you have the same so attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of august Next then and there to be Condemned according to act of assembly to and for the use of the right honourable Margarett Lady Baltemore Executrix of the Last will and testament of the right honourable Charles Lord Baron of Baltemore dec.d unless the Said James Trail Son and heir as afd by himselfe or his attorney shall appear and answer unto the said Margarett Lady Baltemore Exrx as afd in a plea that he render unto her Nine hundred and sixty pounds (of) |
