90 to be held at the town of Cambridge the second tuesday of March then next to answer unto the revered Thomas Howell Rector of great Choptank Parish of a plea of trespass upon the Case &c and that thereof he should not fail &c and a Copy of the Cause of action was sent with the writt in the Plea afd which followeth in these words viz.t Dorchester County ss William Kenney November the 20.th 1722 I have Issued process against you for the sume of Eight thousand pounds of tobo as by an acc.t thereof here in Court ready to be produced may appear and if you do not appear by your selfe or ^your^ attorney at the Next County Court to be held at the town of Cambridge the second tuesday of march next I shall pray for attachment against your Estate &c Allen P Querte Att which said next second tuesday of and twelfth day of march ann Dom One thousand seven hundred and twenty two being the day of the return of the Writt afd Cometh the said Thomas Howell by Francis Allen his attorney and the sherr of Dorchester County to whom the same writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words viz.t Non Est Inventus P John Orrell Sherr Whereupon the said Thomas Howell by his attorney afd prayeth that for as much as he hath Complyed with the Law &c he may have Judgm.t against the said William Kenney for his damages afd and for his Costs and Charges accrueing thereupon by way of attachment and for that it seemeth to the Court here that the said Thomas Howell hath Complyed with the Law as alledged Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Thomas Howell recover against the said William Kenney as well the sume of Eight thousand pounds of tobacco his damages by Occasion of the premisses afd as also all Costs and Charges by the said plft laid Out and Expended about his suite by way of attachment against the goods Chattles rights or Creditts of the said William Kenney according to act of assembly in that Case made and provided &c In testimony whereof I have hereunto (Dorchester Coty) sett my hand and affixt the seall of Dorchester County ^afd^ this twenty Eighth day of July annoqr Dom ( seal ) 1723 G Loockerman Clk memorandum there accrues due to us the Subscriber the sume of fifty four pounds of tobacco for the foregoeing transcript Test G Loockerman Clk Which being read and heard the said Thomas Howell by his attorney afd prays that he may have an attachm.t out of this Court for his damages in the Judgm.t afd mentioned as also for his Costs and Charges accrueing thereupon as also for his Costs and Charges in this Court for the Obtaining the same attachment against the goods Chattles Rights or Creditts of the said William Kenney according to act of assembly &c whereupon all and singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had It's therefore Considered by the Justices here the twentieth day of august Ann Dom One thousand seven hundred and twenty three that the said Thomas Howell have attachm.t against the Goods Chattles rights or Creditts of the said William Kenney according to act of assembly on the Judgmt afd for as well the sum of Eight thousand pounds of tobacco Certain damages afd mentioned as also for his Costs and Charges already (accrued) |
