       to deceive and defraud the afd two pounds twelve shillings and six pence or any Part thereof unto the same Richd
       hath not paid or in any sort Contented altho' to do the same the afd Joseph afterwards to witt the first day of
       July in the Year of Our Lord God One thousand seven hundred and twenty two afd and often afterwards at
       the County afd within the Jurisdiction afd by the afd Robert Richard he was requested but that unto him hitherto
       to pay or in any sort to Content altogether hath refused and shall doth before to the Damage of the said
       Richard of four pounds five shillings mony afd and thereupon he Bringeth Suite &.c Allen P Q Pledge

        Att which said third tuesday of march to witt the Nineteenth day of the same Month Ann Dom one thousand
        seven hundred and twenty two Being the day of the return of the Said Writt Comes the Said Richard Tyler by his
        attorney afd and ye Sherr of Somrsett County to whom the foregoing writt was directed Likewise Comes and makes
        Return thereof to ye Court here Endorst in these words following viz.t Cepi Jos: MccChester Sherr
                         Whereupon the said ^Joseph Pemberton^ Richard Tiler by Levin Gale his attorney Comes and defends the force and
       Injury when &.c and prays that he may have Liberty to answer the declaration in the Plea afd which is Granted
       But afterwards the said Joseph Pemberton altho' Solemnly Called Comes not but makes default where by the
       said Plft remains against ye said deft wholly undefended &c
                   Thereupon ye said Joseph Pemberton by his attorney afd Exhibits to this Court the following amount against
       against ye afd Richard Tyler which is ordered to be recorded as follows vizt
