Cort 1722 by his attorney afd and the sherr of Somrsett County to whom the foregoing writt was directed Likewise Comes and makes return thereof to ye Court here Endorst in these words vizt Cepie Jos: MccChester sherr Whereupon the said John Langford being Called appears and thereupon the said John Langford at the prayer of the Plfts attorney afd is adjudged to give Speciall Bayle to ye action afd thereupon a Certain Dudley Booke of Somrsett County Planter Present herein Court made takes for the said John Langford that in Case the Said Robert Martin shall recover Judgm.t in the plea afd against the said John Langford or that the said John Langford shall be therein Convict that then he the Said John Langford shall pay the Condemnation of the Court thereupon or render his Body to ye Custody of the Sherr of Somrsett County in satisfaction thereof or that he the said Dudley Booke will doe it for him Whereupon the Said John Langford in his Own Proper Person Comes and defends the force and Injury when &c and says that he Cannot gainsay the Plft his action afd so as afd against him Brought nor Can he say but that ye said Plft ought to recover his damages by Occation of the Premisses afd to the sum of four hundred and Sixty Pounds of tobacco and Costs of Suite against him which ye said Plft doth not gainsay Therefore it is Considered by the Justices here the nineteenth day of March Ann Dom One thousand seven hundred and twenty two that the said Robert Martin Recover against the said John Langford as well the sum of four hundred and sixty Pounds of tobo his damages afd in form afd Cost (286) Confesed as also the sum of Two hundred and Eighty Seven pounds of tobacco the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and ye Deft in mercy &c
next to answer unto Richard Tiler of a plea of trespas upon the Case &.c and that there of he should not fail &c And whereupon the same Richard Tyler by francis ALlen his attorney Complains that whereas the afd Joseph the twentieth day of may in the year of Our Lord God One thousand Seven hundred and twenty two at Somrsett County afd and within the Jurisdiction of this Court was Indebted unto the afd Joseph in the Sum of five pounds twelve shillings and six pence Curr.t money of Maryland as by an acco.t thereof herein Court ready to be Produced may appear and so thereof being Indebted to the afd Joseph afterwards to witt the same twenty ninth day of my in the year afd at ye County afd and within the Jurisdiction afd in Consideration thereof upon himselfe did assume and unto the afd Richard then and there faithfully did Promise that he the afd Joseph the same four pounds twelve shillings and six pence unto the same Richard when thereof afterwards he should be required well and faithfully would pay and Content and altho' the afd Joseph two pounds Percell of the afd four pounds twelve shillings and six pence to the said Richard he hath Paid and Satisfied yett as to two pounds twelve shillings and six pence Residue of the afd four Pounds twelve shillings and six pence the said Joseph his premises and assumption afd in form afd Made Little regarding but minding and fraudulently Intending the same Richard in this Part Craftely and Subtely (to) |
