89 Solemnly Called Brings not in the Body of the said Mary Deacent according to the return of his writt in the plea afd but humbly prays the Court that day may be given him till next Court to bring in the said Mary Deacent to answer &c which is granted &c Att which said next Court to witt the twentyeth day of august ann Dom One thousand seven hundred and twenty three Comes the said Mary Deacent here into Court in her proper person ^and^ prays hearing of the presentm.t afd and tis read to her which being read and heard she says that the said Presentm.t and the Matter in the same Contained are Insufficient in law to Charge her Bearing a Bastard Child and that she to that presentmt in manner and form afd hath noe need nor by the law of the Land is she held to answer and this she is ready to verifie wherefore she prays Judgmt and that she may be discharged &c Mary Deacent And the said Lord proprietary by William Tazewell who prosecutes for his said Lord proprietary in the County afd saith that the Plea of Demurer of the deft to the presentm.t afd and the matter in the same Contained are not Sufficient in Law to acquit her the said Mary from being Charged by the Presentm.t afd for bearing a bastard Child and that his Said Lord proprietary to that demurer in manner and form afd made hath use need nor by the Law of Land is Bound to answer and this he is ready to very wherefore for want of a sufficient plea in this part the the said Tazewell who &c prays Judgm.t and that the said Mary may be Convicted on the said Presentment Tazewell P Lopp and the said Mary Joyns in Demurrer Mary Deacent Whereupon all and singular the Premisses by the Court here seen heard and fully understood and mature deliberation thereupon had it seems to the Court here that the ^plea of^ Demurrer afd of the afd Mary Deacent and the mother in the same Contained are not good nor Sufficient in the Law to discharge her the Said Mary from the Presentm.t afd &c Wherefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three afd that the said Mary Deacent be fined to his Lordship the Lord proprietarie his heirs and successors the sume of thirty shillings Curr.t money ^for the fact afd^ which money the said Mary Deacent paid in Court thereupon the said Mary Deacent is discharged M.r Levin Gale undertakes to pay the severall Officers their fees due by action of the Premisses &c
Cap.t Joseph MccClester but near was done and now throw the many Stormes and Gusts the roads is in bad Order from Hutchin's Ferry to tusakey Branch and if your worships se fitt to give me an Order for to Clear the fore mentioned road which is in Length about fourteen miles and I shall also inform your worships of the inhabitants that Lives near to the said road Richard Nicholson, Rich.d Nicholson Jun (James) |
