88 bind her daughter Mary Peirce to him and Ingaged to Learn her to Weave ^and sew^ with her Nedle as well as his wife and to Keep her with good Cloaths Now your Petitioner Complaines that the said Carlyle when he writt the Indenture Pretended he forgott befor the Conditions afd but said he would Comply with the same but your petitioner finding the promise of the sid Carlyle not to be Complyed with but Contrarywide Lays her in the Kitchen or some out house and doth abuse her which doth give me much Cause to suspect his other fair promises the premisses Considered your petitioner prays that her daughter may by the Court be removed or that he may Comply with their actuall agreement and as in duty Bound shall Ever pray Ann Peirce Thereupon Command was given to the sherr of Somersett County that he should sumons the said Alexander Carlyle of Somersett County Gent.m if he should be found in your Bailiwick that all Excuses sett apart he be might be and appear before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek in Somersett County afd the third tuesday of June then next to answer the Petition afd and that he should Bring with him the Said Mary Peirce and her Indenture &c and that thereof he should not fail &c Att which said third tuesday of June to witt the Eighteenth day of the same month ann Dom one thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the Sherr of somersett County to whom the foregoeing writt was directed and makes return thereof Endorst in these words vizt sumoned P Jos: MccChester sherr Whereupon Came here into Court in their proper person as well the said Alexander Carlyle as the afd Petitioner afd but the said Alexander Carlyle Brings not the afd Mary Peirce according to sumons but prays day untill Next Court to answer the petition afd & he hath it and the same day is give the said Ann Peirce the Petitioner also Att which Said next Court to witt the twentieth day of august ann Dom One thousand seven hundred and twenty three Comes againe as well the afd Ann Peirce the Petitioner as the said Alexander Carlyle and Mary Peirce and the petition afd being Read and heard and fully understood and Mature deliberation thereupon had and also the Court haveing heard their severall allegations as well on the part of the Petitioner afd as on the Part of the said Alexander Carlyle It appears to the Court here that the said Mary Peirce the Petitioners daughter has been abused and misused as by the Petition afd is sett fourth &c Wherefore it is Considered by the Justices here that the said Ann Peir Mary Peirce return who home to her said Masters Service and that the said Alexander Carlyle doe not for the future abuse the said Mary Peirce as formerly he had done as not now appears in Court &c
Thereupon Command was Given to the Sherr of Sommersett County that he should take the said Mary Deacent Spinster of Somersett Parish if she should be found in his Bailiwick and her should Safe Keep so that he might have her Body Before the Justices of his Lordships County Court of Somersett ^to be held at Dividing Creek^ the third tuesday of June then next to answer unto his said Lordship Concerning a Certain Presentm.t against her found and that thereof he should not faile &c which said third tuesday of June to witt the Eighteenth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the sherr of Somersett County and makes return thereof Endorst viz.t Cepi Corpus Jos: MccClester sherr Whereupon the said sherr altho' (solemnly) |
