          August Court            1723             87
          Whereupon the said Elizabeth Burcham in her own proper person appears and being sett to the Bar is
          thereupon Instantly demanded how she would acquitt herselfe of the Premisses afd above Imposed upon her
          Says that of the Premisses afd above Imposed upon her she is guilty thereof and submitts to the mercy of the Court
          and makes oath that a Certaine Henry Friggs is the father and Begetter of the Child she stands presented for and
          is willing to pay her fine for the fact afd &c  Wherefore it is Considered by the Justices here the twentieth day
of august Ann Dom One thousand Seven hundred and twenty three that the said Elizabeth Burcham be fined to his
Lordship the Lord Proprietarie the sume of six hundred pounds of tobacco for the fact afd thereupon It's ordered by
the Court that the said Eliz.a Burcham give Security for the fine afd and all the Officers fees that hath accrued by occation
of the premises   Thereupon a Certain John reed of Somrsett County present here in Court undertakes for the Said Eliz.a
Burcham and acknowledged himselfe to owe and stand Justly Indebted unto his Said Lordship his heirs and successors
in the sum of teen pounds Curr.t money to be Levied on his Body Goods or Chattles Lands or tenements for the use of his
Lordship in his Case they doe not pay and satisfie the fine afd and all the Officers their fees that accrued by action of the premisses

Command was given to the Sherr of Somersett County that he should take Bryan Magrow of

Somersett County Planter if he should be found in his Bailiwick and him should Safe Keep so that
                   he might have his Body Before the Justices of his Lordships Justices of the Peace of the County Court of
Sommersett ^to be held at Dividing Creek^ the third tuesday of August then Next to answer unto his said Lordship Concerning his Committing fornication
with a Certaine Mary Osten and Begetting of her Body a bastard Child &c and that thereof he should not faile &c

             Att which Said third tuesday of august to witt the twentieth day of august the same month ann Dom One thousand
seven hundred and twenty three being the day of the return of the said Writt Comes the Sherr of Somersett County afd and
makes the return thereof to the Court here Endorst in these words following vizt Cepi Corpus Jos: MccClester Sherr
       Whereupon the said Bryan Magrow in his own proper person appears and being sett to the Barr is thereupon
Instantly demaned how he would acquitt himself of the Premisses afd above Imposed upon him says that of the Premisses
afd above Imposed upon him says that he is guilty thereof and submitts to the Mercy of the Court and is willing to Suffer
Corporall punishm.t for the fact afd         Wherefore it is Considered by the Justices here that the said Bryan Magrow be had
to the publick whiping Post and there be whipt on the Bare Back with fifteen Lashes well Laid on untill the Blood appear
and thereupon as to the Corporeall Punishment afd Command is given to the Sherr of Somersett County that he do thereof Imediate
Execution according to the Judgm.t afd rendered by whiping the afd Bryan Magrow at the Publick Whiping post with
fifteen Lashes on the Bare Back well Laid on untill the Blood appear and afterwards in the same Court the sherr returns
that he has done the Execution of the Judgm.t afd as to the Corporal Punishment afd he was Commanded for as much as the said
Bryan Magrow being a Servant to M.r Bozman it Ordered that he return Whom into his Masters Service and that his
said Mester return him to the County Court or the Sherr of the County at the Expiration of his service to reimburst the County
the tob.o paid for him to the severall Officers ^for^ their fees they Charging the County with the same according to Law &c

June ye 18.th 1723    Wee of the Orphan Jury do find that M.r John Painter of Somersett County of

all holows Parish doth make waste of the Estates of Thomas Painter and Mary Painter Orphans
