87 Upon the mocon of M.r Francis Allen on behalfe of a Certain Cornelius Morris a pore ancient Person against a Certain Sumersett Dickenson who Intermarried with the daughter of the said Cornelius &c And whereas the said Cornelius Morris by an agreement Between him and the said Somersett Dickenson that if the said Cornelius Morris would deliver unto him the said Somersett all his stock houshold stuff and what substance he had that he the said Somersett would find and provide for him the said Cornelius a Sufficient maintainance &c But since the deliver of the stock held houshold stuff and Other substance of the said Cornelius unto the said Somersett he the said Somersett hath not Complyed with his agreem.t as on his part ought to be performed as by the said Cornelius appears here in Court &c Whereupon the Court haveing heard their severall allegations as well on the Part of the said Complainant as on the part of the said Somersett and having maturally weighed and Considered the same It's Ordered by the Court that the said Cornelius Morris return whom with the said Somersett Dickenson and that the said Somersett Dickenson Comply for the future with the agreem.t upon pain and perill that shall fall thereon &c Upon the mocon of Thomas Hayward Clk of Somersett County Court for the Building a house on the publick Land at Somersett County Court house at Dividing Creek for his Ofice Granted according to the mocon afd &c Thomas Hayward Clk of Sommersett County Offers William Taylor as his deputy to this Court who is appeared of and took the severall Oaths appointed by act of assembly and subscribed the Oath of abjuration & test upon the mocon of M.r Alexander Hall Late Clk of Somersett County Court for the amendment of a Certain record that he had made against a Certain Thomas Carry of Somersett County that whereas the said Thomas Carry was fined five thousand pounds of tob.o for the Breach of a penall Law of this Province and the said Alexander Hall in Entering and makeing upon of the same record entered the fine five hundred pounds of tobacco and the same in figures &c thereupon it's ordered by the Court that the said Alexander Hall have the Liberty to amend the same record &c
Thereupon Command was given to the Sherr of Somersett County that he should take the said Elizabeth Burcham Spinster if he should be found in his Bailiwick and her should Safe Keep so that he might have her Body Before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of August then next to answer unto his Lordship Concering a Certain presentment against her found and that thereof he should not fail &c Att which said third tuesday of august ann Dom One thousand Seven hundred and Twenty three being the day of the return of the Said Writt Comes the Sherr of Somersett County to whom the foregoeing writt was directed Com and makes return thereof Endorst in these words vizt Cepi Corpus Jos: MccChester sher (Whereupon) |
