and the said James Smith dying Left some Considerable Estate which have Never Been appraised which Causes suscation that the Orphan will Never be the Better for what his father Left him I your Pers Petitioner do humbly Crave that your worships will Inquire into it and Cause the Orphan to be Better dealt by ord removed to some good Body that will take Care of him and I your Petitioner as in duty Bound shall Ever pray Thereupon Command was given to the Sherr of Somersett County that he should sumons the said John Langsdale if he should be found in his Bailiwick that all Excuses sett apart he ^might^ be and appear before the Justices of his Lordships County Court of Somrsett to be held at Dividing Creek the third tuesday of August then next and Likewise that he should have the same orphan at the day and place afd and that thereof he should not fail &c Att which said third tuesday of august to witt the twentyeth day of the same month ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Comes the Sherr of Somersett County and makes return thereof Endorst in these words vizt Sumoned P Jos: MccChester Sherr Whereupon appears here in Court as well the said John Langsdale with the said Orphan as the Petitioner afd and the Court haveing heard their Severall allegations as well on the Part of the Said John Langsdale as on the Part of the afd Petitioner and maturally weighed and Considered ^the^ Premisses are of Opinion that it would tend most to the Interest of the said Orphan to be Bound Out to some good Person that will take Care of him and give him Education &c Whereupon the afd Orphan Called David Smith is bound by the Court unto William Stoughton Esqr untill he arrives to the age of twenty one years he being fourteen years of age next January the said David Smith to serve the said William Stoughton his said Master the said term of time afd in all such Imploym.t and Lawfull Service ^as^ he should Imploy him in or about In Consideration of which service so as afd to be performed by the said ^the said^ William Stoughton is to Learn the said David Smith to read well in the Bible and to write Whereupon it is Ordered by the Court that the Said William Stoughton give Security for the Performance of the Covenants afd Thereupon the Said William Stoughton with Maj.r Charles Ballard his Security acknowledged themselves to Owe and Stand Justly Indebted unto the said David Smith in the sume of fifty pounds Curr.t money to be Levied on the Bodys goods or Chattles Lands or tenements for the use of the said David Smith In Case the said William Stoughton doth not Learn him to read well in the Bible and write and to find him sufficient meat drink washing Lodging and Cloathing mete for such an apprentice to have and wear dureing the servitude afd &c |
