85 Lycence thereof then the above recognizance to be void &c
Court without Lycence thereof thereupon the said Thomas Walker present here in Court acknowledg'd himselfe to Owe and stand Justly Indebted unto his Lordship the right honourable the Lord Proprietarie in the Sum of twenty pounds Curr.t money to be Levied on his Body goods or Chattles Lands or tenements for the use of his said Lordship the Lord proprietarie his heirs and successors, in Case he do not make his personall appearance before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of august November next and then and there give Such Evidence as he shall Know against Mary Cavanough Sarah Walker Jun.r Susannah Walker, and Mary Walker of and Concerning their feloniously stealling the ^Certain^ Cloaths the goods of Merrick Ellis and John Banister and ^do^ not depart the same Court without Lycence thereof then the above recognizance to be void &c Ordered by the Court that Thomas Walker of Somrsett County Gent deliver upon unto Mary Cavanough his Late servant all her wearing Cloaths and other goods that is to say ten yards of worsted stuf a pair of Stays and two Wascoats &c
himselfe to be Indebted unto his Said Lordship In the sume of ten pounds sterling each to be Levied on their goods and Chattles Lands & tenements for the use of his said Lordship if he fail in the Condition hereafter mentioned mentioned the Condition of the above recognizance is such that if William Young afd doe ^be^ of the peace and good Behaviour to all his Majesties good Subjects of this province and Especially to John Huffington of of Somersett County and make his personall appearance before the Justices of ^the^ Peace for the County afd in Court sitting to be held at Dividing Creek the third tuesday of august Instant to answer what shall be Objected against him on his Lordships Behalfe and stand and abide the Judgm.t of the Court then this recognizance to be void Else to be and remain in full force and vertue in Law &c John Handy Now here at this day to witt the the twentieth day of August ann Dom One thousand seven hundred and twenty three personally appeared herein Court the afd William Young and prays that his appearance may be Entered to save himselfe and security from the above recognizance of Bail so as afd Entered into thereupon the said William Young's appearance is Entered and he and his security accordingly discharged &c Whereas severall summons's hath Issued Out of this Court against a Certain Mary Ennis to appear before the ^Justices thereof^ Court to give Evidence on Behalfe of the Lord Proprietary and for as much as the said Mary Ennis is since ^Inter^Married to a Certaine Benj.a B Tull she would not Obey the said Preceipt whereupon at the Mocon ^of^ Wm Tazewell Prosecutor of his Lordships Pleas in this Court, It's Ordered by the Court that Summons Issue against the said Mary Ennis by the Name of Mary Ennis alias Tull &c |
