and acknowledged herselfe to Owe and stand Indebted to the said Lord Proprietarie fifty pounds sterling of her goods and Chattles Lands and tenements to be Levied for the use of the said Lord Proprietarie his heirs and successors if Default be made of the Condition below Written the Condition of the above recognizance is such that if the above Bound anne Shiles shall personally appear at the Next Court of the County afd to be held at Dividing Creek the third tuesday of this Instant august and do then and there give Such Evidence as she shall Know against Mary Cavanough, Sarah Walker sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker of and Concerning their feloniously stealling Certain Cloaths the goods of Merrick Ellis and John Banister and do not depart thence without Leave of the Court that then this recognizance to be void Charles Ballard W.m Stoughton Sommersett fs.t Memorand.m that the thirteenth day of august One thousand seven hundred and and twenty three Elizabeth Hust Came Before us Charles Ballard and William Stoughton Gent two of his Lordships the Lord Proprietaries Justices the Peace in the County afd to Keep, assigned and acknowledged herselfe to be Indebted unto his said Lordship fifty pounds sterling of her goods and Chattles Lands and tenements to be Levied for the Use of his said Lordship his heirs and Successors if default be made of the Condition below Written The Condition of which recognizance is such that if the afd Elizabeth Hust shall personally appear at a Court of the County afd to be held at Dividing Creek the third tuesday of August next Instant and doe then and there give Such Evidence as she shall Know against Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker of and Concerning their feloniously stealling Certain Cloaths the goods of Merrick Ellis and John Banister and doe not depart thence without Leave of the Court that then this recognizance to be void Cha Ballard Will.m Stoughton Now here at this day to witt the twentyeth day of august ann Dom One thousand Seven hundred and twenty three personally appears here in Court the above Mamed Ann Shiles and Elizabeth Hust & prays that their appearance may be Entered to save themselves from the above recognizance of Bail by them Entered into theirupon the said Ann Shiles and Elizabeth Hust's appearance are Entered and they accordingly discharged Whereupon the said Ann Shiles and Eliz.a Hust is Ordered to give New recognizance with one Surety for their appearance at Next Court to give Such Evidence as they shall Know against Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker, and Mary Walker &c Thereupon William Stoughton of Somrsett County Esq.r present here in Court undertakes for the said Ann Shiles and Eliz.a Hust And acknowledged himselfe to Owe and Stand Justly Indebted unto his Lordship the Lord Proprietarie in the sum of forty pounds Curr.t money (for the use of the said Lord Proprietary his heirs and Successors) to be Levied on his Body goods or Chattles Lands or tenements &c In Case the said Ann Shiles and Eliza Hust do not make their personall appearance Before the Justices of Our County Court to be held at Dividing Creek In Somrsett County afd the third tuesday of this Instant November next and then and there give Such Evidence as they shall Know against Mary Cavanough Sarah Walker Sen Sarah Walker Jun.r Susannah Walker and Mary Walker of and Concerning their feloniously stealling Certain Cloaths the goods of Merrick Ellis and John Banister and do not depart the same Court without (Lycence) |
