84 Entered to save himselfe from the recognizance of Bail afd thereupon the afd John Banister appearance is entered as afd is praid and the said John Banister discharged &c Whereupon the said John Banister is ordered by the Court to give New recognizance for his appearance at next Court and to give Such Evidence as he shall Know against Mary Cavanough, Sarah Walker Senr Sarah Walker Jun.r Susannah Walker, and Mary Walker &c Thereupon the said John Banister present here in Court acknowledged himselfe to owe and stand Justly Indebted unto his said Lordship the Right honourable the Lord Proprietarie his heirs and successors in the sume of twenty pounds Currt money to be Levied on his Body goods or Chattles Lands or tenements for the use of his said Lordship the Lord Proprietarie his heirs and successors In Case he doe not make his personally appearance Before the Justices of Our County Court to be held at dividing Creek in Somersett COunty afd the third tuesday of November next and then and there doe give Such Evidence as he shall Know on Behalfe of the said Lord proprietarie against Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker, and Mary Walker of and Concerning their feloniously stealling Certaine Cloaths from the afd Merrick Ellis and John Banister and doe not depart the same Court without Lycence thereof then the above recognizance to be void &c Ann Wilkins Recognizance Sommersett County ss.t Memorandm that the twentieth day of august one thousand seven hundred and twenty three Ann Wilkins of the County afd Came Before us Charles Ballard and William Stoughton Gent two of his Lordships the Lord Proprietaries Justices of the peace in the County afd to Keep assigned and acknowledged herselfe to be Indebted unto the said Lord Proprietarie fifty pounds sterling of her goods and Chattles Lands and tenements to be Levied for the use of his said Lordship his heirs and Successors if default be made in ye Condition below Written the Condition of which recognizance is such that if the above Bound Ann Wilkins shall personally appear at the next Court of the County afd to be held at Dividing Creek the third tuesday of this Instant august and then and there give Such Evidence as Shee Shall Know against Mary Cavanah Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker of and Concerning their feloniously stealling Certain Cloaths the goods of Merrick Ellis and John Banister and do not depart thence without Leave of the Court that then this Recognizance to be void &c Char Ballard, Wm Stoughton Now here at this day to witt the twentieth day of august ann Dom One thousand Seven hundred and twenty three personally appeared herein Court the said Ann Wilkins and prays that he appearance may be Entered to save her recognizance of Bail Entered into as above said thereupon the said Ann Wilkins appearance is Entered as afd Praid and she accordingly discharged therefrom &c Whereupon it is Ordered by the Court that the said Ann Wilkins give New recognizance for her appearance at next Court to give Evidence against the said Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker &c thereupon the said Ann Willkins present here in Court acknowledged herselfe to owe and Stand Justly Indebted unto his Said Lordship the right honourable the Lord Proprietarie his heirs and Successors in the Sum of twenty pounds Curr.t money to be Levied upon her Body goods or Chattles Lands or tenements for the use of the said Lord proprietarie In Case the Said Ann Wilkins doe not make her personall appearance before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of November Next And then and there give Such Evidence as she shall Know on behalf of the said Lord Proprietary against Mary Cavanough Cavanough, Sarah Walker Sen.r Sarah Walker Jun.r; Susannah Walker, and Mary Walker, of and Concerning their feloniously Stealling Certain Cloaths the goods of Merrick Ellis and Jno Banister and do not depart the same Court without Lycence ^thereof^ then the above recognizance to be void &c |
