83 Stoughton Gent two of his Lordships the Lord Proprietaries Justices the Peace in the County afd to Keep assigned and acknowledged himselfe to be Indebted unto his said Lordship fifty pounds sterling of his goods and Chattles Lands and tenements to be Levied for the use of the said Lord Proprietarie his heirs and successors if default be made in the Condition below Written The Condition of which recognizance is such that if M.rs Alice Ellis of the County afd shall personally appear at the Court of the County afd to be held at Dividing Creek the third tuesday of this Instant august and do then and there give such Evidence as she shall Know against Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker of and Concerning their feloniously stealing Certain Cloaths the goods of Merrick Ellis John Banister and do not depart without Leave of the Court that then this recognizance to be void Charles Ballard Will.m Stoughton Now here at this day to witt the twentieth day of August ann Dom One thousand seven hundred and twenty three appears here in Court the said Alice Ellis and prays that her appearance may be recorded to save her security from the above recognizance of Bail Entered into as afd thereupon the said Alice Ellis appearance is recorded and her security is accord^ingly^ discharged therefrom Where upon it Ordered by the Court here that the afd Merrick Ellis and alice his wife give New recognizance for their appearance at Next November Court to give Evidence on Behalfe of the Lord Proprietary against Mary Cavanough Sarah Walker Sen Sarah Walker Jun Susannah Walker and Mary Walker &c thereupon the said Merrick Ellis present her in Court under takes for himselfe and Alice his wife and acknowledged himselfe to Owe and Stand Justly Indebted unto his Said Lordship the right honourable the Lord Proprietary his heirs and successors in the sume of forty pounds Curr.t Money to be Levied on his Body goods or Chattles Lands or tenements for the use of the said Lord Proprietarie In Case ^he^ the said Merrick Ellis and Alice his wife doe make their personall appearance before the Justices of Our County Court to be held at Dividing Creek in Sommersett County afd the third tuesday of November Next and then and there give ^such^ Evidence as they Know against Mary Cavanough Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker on Behalfe of the said Lord Proprietarie of and Concerning their feloniously stealling Certain Cloaths from the afd Merrick Ellis and John Banister and doe not depart the same Court without Lycence thereof then the above recognizance to be void &c Merrick Ellis of Sommersett County Gent appears according to his recognizance entered into before Charles Ballard & William Stoughton Gent two of his Lordships Justices of the Peace of the County afd who is discharged and ordered to give New recognizance as above &c
