(80) thereupon Command was Given to the Sherr of Sommersett County that he should summon the said Orphan Boy if he should be found in his Bailiwick that all Excuses sett apart he be ^&^ appear before the Justices of Our County Court of Somersett afd to be held at Dividing Creek the third tuesday of august then next to answer the petition afd and that there of he should not faile &c Att which said third tuesday of august next to witt the twentieth day of the same month ann Dom one thousand seven hundred and twenty three Comes the sherr of Somersett County and makes return thereof Endorst to the Court here viz.t Sumoned p Joseph MccChester Sherr Whereupon appeared here in Court the Petitioner afd as also the said Orphan Called John Warren and the Court haveing heard their severall allegations as well on the part of the Petitioner afd as on the part of the said Orphan and having deliberatly Considered the same thereupon the said John Warren by his assent and the Court is bound by the Court unto Catherine Purnell Widdow of Capt Thomas Purnall afd dec.d untill he arives to the age of twenty one years of age he being Seventeen years Old Last march the said Catherine Purnall to Learn the Said John Warrent to read and write and to give him a new suite of Cloaths at the Expiration of his servitude and Like wise to give him Now at this time a Cow and Calfe the same Cow and Calfe to remain with the Stock of the said Catherine Purnell untill the Expiration of the service afd and then the said Catherine Purnell to deliver upon unto the said John Warren the said Cow and Calfe with all her Increas &c It's thereupon Ordered by the Court that the said Catherine Purnell Give security for the performance of the Covenants afd Whereupon the Said Catherine Purnell with John Turvill her security present here in Court acknowledged themselves to Oweand and stand Justly Indebted Joyntly and Severally unto the Said John Warren in the sum of twenty pounds Curr.t mony to be levied on their Bodys goods or Chattles Lands or tenements for the use of the said John Warren in Case the said Catherine Purnell shall not Comply with the Covenants afd &c
Tax free but in the last Gust of weather your petitioner had a house Brown down upon her which hath to Bruised her and Brok some of her Bones Especially one of her thigh Bones so that she is altogether Us^e^less who hopes your worships will take it into your Judicious Considerations and Aleviate him from paying taxes for her she being only a Charge to your petitioner and altogether uncapable of doing any manner of service and your worship's Petitioner as in duty Bound Shall pray Adam Spence Jun Whereupon the petition afd being read and by the Court heard and fully deliberated and It's Considered by the Justices that the said Negro woman of the afd adam Spence Jun be Levy free for this year &c
