77 damage of him the said Elishaw and against the peace of the right honourable the Lord Proprietary of this province his good rule and Government whereupon the said Elishaw saith he is worse and hath damage to the value of fifty pounds Curr.t money of Maryland and thereupon he bringeth suite &c Allen P Quer Pledg deft Jno doe & Richd Roe And the said Robert farmer by George Dashiell his attorney Comes and defends the force & Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt twentieth day of November ann Dom One thousand seven hundred and twenty two Comes againe as well the said plft by his attorney afd as the said deft by his attorney afd and the said deft by his attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the Plft also Att which said next Court to witt the Ninteenth day of March ann Dom One thousand seven hundred & twenty two Comes againe as well the said Plft by his attorney afd as the said deft by his attorney afd and the said deft by his said attorney says that he is not Guilty in Manner and form and of this he putts himselfe upon the Country Dashiel P Deft and whereupon the said deft by his said attorney prayes that the afd Plft to his plea afd above pleaded may answer Whereupon day is given by the Court here to the afd Plft untill next Court to answer to the afd Plea of the afd deft above Pleaded and the same day is given to the deft also Att which said next Court to witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Comes againe the said deft by his attorney afd and the said Plft altho solemnly Called Comes not nor to the Plea of the afd deft above Pleaded answereth nor is his writt and declaration against the same deft in the Plea afd further Prosecuted Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Elishaw Stringfellow and his Pledges of Prosecuting that is John Doe and Richard Roe be in mercy &c and for that the said Robert farmer goe thereof without day and further it is Considered by the Justices here that the said Robert Farmer recover against the said Elishaw (296) Stringfellow the sume of Two hundred & Ninty Six pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in that part sustained according to the form of the Statute lately made and provided and that the same deft have thereof his Execution &c
sume of sixteen hundred and twenty four pounds of tobacco to be Levied of you Bodys Goods or (Chattles) |
