Chattles Lands or tenements for the use of the said Thomas Brereton in Case the said William Brereton shall
not pay and satisfie to the said Thomas Brereton the said sume of sixteen hundred and twenty four pounds
of tobacco so as afd recovered against him with the additional Costs thereon on the tenth day of November Next Ensueing
the date hereof acknowledged before us two of his Lordships Justices of the peace for Sommersett County this

 Sommersett County ss.t   John Paynter of all hollows Parish in the County
of Sommersett was attached to answer unto Richard Edge of a plea of trespass
upon the Case &c 

              And whereupon the said Richard by Francis Allen his attorney Complains that whereas the
       afd John the twenty second day of September in the year of Our Lord God one thousand seven hundred
and fifteen at the afd Parish and County and within the Jurisdiction of this Court was Indebted unto the
afd Richard in the sume of twenty five pounds six shillings and two pence being as well for work done by
the said ^Richard^ for the afd John as also for divers good wares and merchandizes by the same Richard unto the afd
John at the Speciall Instance and request of the same John Before that time there sold and delivered
as by an acco.t thereof here in Court ready to be produced may appear and so thereof being Indebted the
afd John afterward to witt the same two and twentieth day of September in the year afd at the County afd
and within the Jurisdiction afd in Consideration thereof upon himselfe did assume and unto the afd
Richard then and there faithfully did Promise that he the afd John the same twenty five pounds six
shillings and two pence unto the same Richard when thereof afterwards he should be required well
and faithfully would pay and Content Nevertheless the afd John his promise and assumption afd so as it is said
made nothing regarding but minding and fraudulently Intending this said richard in this part Craftilly
and Subtilly to deceive and defraud the afd twenty five pounds six shillings and two pence or any
part thereof unto the same Richard hath not paid or in any sort Contented altho' to doe the same
the afd John Afterwards to witt the first day of august in the year of Our Lord God seventeen hundred &
twenty two at the County aforesaid within the Jurisdiction aforesaid by the aforesaid Richard he
was required but that unto him hitherto to pay or in any Sort to Content altogether hath refused
and still doth refuse to the damage of the said Richard of fifty pounds Money aforesaid
and thereupon he Bringeth Suite &c
