73 And the said Thomas Anderson by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle here unto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the tw Eighteenth day of June Ann Dom One thousand seven hundred and twenty three Comes againe as well the said John Rider by his attorney afd as the said Thomas Anderson by his attorney afd and the said Thomas Anderson by his said attorney as before defends the force & Injury when &c and says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft Ought to recover his damages by occasion of the premises afd to the sume of three pounds Eighteen shillings and Costs of suite against him which the said plft does not gainsay &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said John Rider Recover against the said Thomas Anderson as well the sume of three pounds Eighteen shillings Certain damages afd in form afd Confesed as also the sume of Two hundred and Eighty (284) four pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and the defend.t in Mercy &c
and twenty two at the parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in two thousand three hundred twenty and six pounds of tobacco for Creditt given a Certain John Layton and for Levys and publick dues and forbearance thereupon to the said Robert then and there due owing and unpaid as by an account thereof hereunto annexed may in Court appear and being so thereof Indebted the said George in Consideration thereof afterwards to witt the day and year afd at the place afd upon himselfe did assume and to the said Robert then and there did faithfully promise that he the said George the afd two thousand three hundred and twenty six pounds of tobacco unto the said Robert when he should be afterward thereunto required he would well and faithfully pay and Content and altho' the said George six hundred and seventy pounds of tobacco Pcell of the afd two thousand three hundred twenty and six pounds of tobacco to the said Robert he hath paid and satisfied yett as to one thousand six hundred fifty and six pounds of tobacco residue of the afd two thousand three hundred twenty and six pounds of tobacco the said George his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said Robert in that part Craftilly and Subtilly to deceive and defraud the afd One thousand six hundred ^fifty^ and six pounds of tobacco to the said Robert he hath not paid or to him for the same in any wise Contented altho' the same to doe the said George by the same robert on the first day of December in the year afd and often afterwards at the Parish and County afd within the (Jurisdiction) |
