72 One thousand seven hundred and twenty three Comes againe the said Thomas Dashiell by his attorney afd and the said prays that the said Philip Selby to his declaration in the plea afd may answer but the said Philip Selby altho solemnly Called Comes not but makes default Whereby the said plft remains against the said deft thereof undefended of that the afd Plft his damages by occasion of the premisses afd against the afd Philip Selby ought to recover Whereupon at the prayer of the afd Plft the Justices here according to act of assembly in that Case made & Provided do assess the damages of the same plft by occasion of the premisses afd besides his Costs and Charges by him about his suite in that part sustained to five hundred and thirty four pounds of tobo Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Thomas Dashiell recover against the said Philip Selby as well the sum of five hundred and thirty four pounds of tobo Certain damages afd in form afd assessed as also the sume of four hundred & eighty (480) pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and the deft in Mercy &c
and twenty two at the afd Parish and County and within the Jurisdiction of this Court was Indebted unto the afd John in the sum of four pounds sixteen shillings for twenty four days here of the said John Sloop by the said John unto the afd Thomas at the Speciall Instance and request of the same Thomas before that time ^there^ Lett to hire as by an account account thereof there ready in Court to be produced may appear and so thereof being Indebted the afd Thomas afterwards at the County afd and Within the Jurisdiction afd in Consideration thereof upon himselfe did assume and to the afd John then and there faithfully did promise that he the afd Thomas the same four pounds sixteen shillings unto the same John when thereof afterwards he should be required well and faithfully would pay and Content and altho' the afd Thomas Eighteen Shillings Pcell of the afd four pounds sixteen shillings to the said John he hath not paid and satisfied yett as to three pounds Eighteen Shillings residue of the afd four pounds sixteen shillings the said Thomas his promise and assumption afd afd in form afd made Little Regarding but minding and fraudulently Intending the same John in this Part Craftilly and Subtilly to deceive & defraud the afd three pounds Eighteen shillings or any part thereof unto the same John hath not paid or in any sort Contented altho' to do the same the afd Thomas afterwards to witt the first day of November in the year of Our Lord God seventeen hundred and twenty two afd at the County afd within the Jurisdiction afd by the afd John he was Requested but that unto him hitherto to pay or in any sort to Content altogether hath refused and still doth refuse to the damage of the said John of seven pounds Eight shillings money afd and thereupon he bringeth suite &c Allen P Qrte Pledges deft Jno Doe richd Roe 1722: Sep.t 7.th Thomas Anderson D.r £ 1722 P Contra Cr for hire of my Sloop 24 days @ £6 P mo 4..16..
