against the said William Summers as well the sum of two pounds seven shillings and one penny his damages afd
(244)   In form afd Confesed as also the sum of Two hundred & forty four                                 pounds of tobo
by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid Out and Expended
and the Deft in mercy &c

 Sommersett County s.s  John Barclet of Sommersett County in the province of maryland
planter alias dictus John Barcley of Sommersett County planter was Sommoned
to answer unto Mathew Kinnigan of a plea that he render unto him the penall
sum of one thousand pounds of good sound merchantable tobacco and Caske wch
       to him he Ows and from him he unjustly detains &c
                               And whereupon the said Mathew P George Dashiell his attorney Complaines that whereas the
said John the twentieth day of November Ann.o Dom One thousand seven hundred and seventeen at wickacomoco
with in the Jurisdiction of this Court was Indebted unto the said Mathew in the penall sum of One thousand pounds of
good sound Tobo as P a Certain Writeing Obligatory dated the day and year afd which the said Mathew with the seall of
the said John signed into Court doth Bring Nevertheless the said John the afd sum of one thousand pounds of tobacco
unto the said Mathew according to the tenour of his said Writeing altho' often thereunto requested he hath not
rendered nor in any ways Contented but the same to render hatch deneyed and still doth deny to the damage of the said
Mathew of two thousand pounds of tob.o and thereupon he brings suite
                                           Dashiell P Quer pledges Jno Doe Richd Roe

       And the said John Barkley in his own proper person Comes and defends the force and Injury when &c  and prays
Leave to Imparle hereunto hereunto untill the next Court and he hath it and the same day is given to the plft also
    Att which said next Court to witt the ^Eighteenth^ twentieth day of June Ann Dom One thousand seven hundred and ^twenty^ three Comes
again the said Mathew Kinnigan by his attorney afd and prays that the said John Barkley to his declaration in the
plea afd may Answer; But the said John Barkley Oltho' Solemnly Called Comes not but makes default whereby
the said plft Remains against the said deft thereof undefended
        Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Mathew
Kinnigan Recover against the said John Barkley as well the sume of One thousand pounds of tobacco his
debt afd as also the sume of Two hundred & forty one                                                pounds of tobacco
(241)    by the Court here adjudged unto him for his Costs and damages sustained by Occation of the detaining the same
debt and the deft in Mercy &c

Pse   Philip Selby
 Sommersett County ss.t  Philip Selby of all hollows Parish in the County of Sommersett planter was
attached to answer unto Thomas Dashiel of a plea of trespass upon the Case &c
And whereupon the said Thomas by Francis Allen his attorney Complains that whereas
                   the said Philip the first day of November ann Dom One thousand seven hundred and twenty two at
       the parish and County afd within the Jurisdiction of this Court was Indebted unto the said Thomas three thousand
