71 in the Just Sum of two pounds seven shillings and One Penny Curr.t money of Maryland as P accot hereunto annexed may in Court appear and being Indebted as afd for and In consideration afd at the time and place afd did upon himselfe assume and promise that the afd sum of two pounds Seven shillings and one penny he would well and truely pay and Content when he shall be thereunto requested Nevertheless the said William his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Contriveing him the said James in that part Craftilly to deceive and defraud altho' often thereunto requested he hath not paid but the same to pay altogether refuseth and still doth refuse to the Damage of the said James of four pounds fourteen shillings and two pence Like money and thereupon he Brings this Suite Dashiell P Quer pledges Jno Doe & richd roe August ye 2.d 1722 York river W.m Summers D.r
November 22.d 1722 then Came Capt James Lindow and took his Oath on he holy Evangelist of almighty God that the above acct is Just and true and that he Never received any part thereof Jurat Coran Charles Ballard And the afd William Sumers by William Tazewell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle here unto untill the next Court and he hath it and the same day is Given to the Plft also Att which said next Court to witt Eighteenth day of June Ann Dom One thousand seven hundred and twenty three Comes againe as well the said James Lindow by his attorney afd as the said William Sumers by his attorney afd and the said William Tazewell attorney for the said William Sumers says that he is not Informed of any answer for thereof the same deft to the afd Plft in the plea afd to be given and nothing Else thereof says by that the same plft remains against the afd deft thereof undefended of that the afd Plft his damages by Occasion of the Premises afd he ought to recover Whereupon the Justices here at the prayer of the same plft do assess the damages of the same Plft by occasion of the Premisses afd besides his Costs and Charges by him about his Suite in that part sustained to two pounds seven shillings and One penny Curr.t money Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand Seven hundred and twenty three afd that the said James Lindow recover (agt) |
