70 of the Within Writt to me directed to the Justices within Mentioned I Certifie that I have attached as the goods and Chattles rights and Creditts of the Within Names Thomas Maddocks to the value of Four pounds fourteen Shillings Curr.t money and five hundred pounds of tob.o in the hands of Joseph MccChester and I further Certifie that I have given Notice unto the said Joseph MccChester that he be and appear before the Justices within Mentioned at the time and place within Contained to shew Cause if any he have why the same should not be Condemned in his hands towards satisfying unto the Within Named Benjamin Cottman his damages and Costs within Contained before John Doe & richard roe good and Lawfull men of my Bailiwick as by the within writt I am Commanded so answers Cha Ballard Coronr Whereupon the afd Joseph Macchester Garnishee of the afd Thomas Maddocks appears in his own proper person and says that he Cannot gainsay but that he has of the rights and Creditts of the said Thomas Maddocks to the value of one pound twelve shillings and four pence; nor but that the same ought to be Condemned in his hands for the use of the said Benjamin Cottman as of the rights and Creditts of the said Thomas Maddocks which the said plft does not gainsay Whereupon the said Benjamin Cottman by his attorney afd prays that upon giveing security according to act of assembly the sum afd so as afd Confesed by the afd Joseph MccChester as of the rights and Creditts of the said Thomas Maddocks may be Condemned in the hands of the said Joseph MccChester towards satisfying unto the said Benjamin Cottman as well the sum of four pounds fourteen shillings Currt money and five hundred pounds of tobo as also the Costs accrueing upon the Writt of attachm.t afd Thereupon George Dashiell of Somrsett County Gent present herein Court undertakes for the said Benjamin Cottman according to act of assembly that in Case the said Thomas Maddocks do at any time within a year and a day appear and make all or any part of the Claime of the said Benjamin Cottman against him appear to be satisfied or otherwise to have been undue before the Laying of this attachment that then the said Benj.a Cottman shall make restitution to him the said Thomas Maddocks of all or such part thereof as shall be made appear to be undue &c or that he the said George Dashiell will doe it for him Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said sum of one pound twelve shillings and four pence part of the sum so attached and Confesed be Condemned in the hands of the said Joseph Macchester as of the rights and Creditts of the said Thomas Maddocks towards satisfying unto the said Benjamin Cottman as well the sum of four pounds ^fourteen shill^ Currt Mony and five hundred pounds of tobo and C as also the Costs accrueing upon the writt of attachm.t afd and that the Said Benjamin Cottman have his Execution thereof against the said Jos: Macchester according to act of assembly Mem.d the Garnishee Jos: Macchester voluntarily takes his Oath that he hath noe more of the Effects of the defts in his hands then what he has Confesed
and County afd vizt at york river within the Jurisdiction of this Court was Indebted unto the said James (in) |
