68 that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands Ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and Provided if to him her or them it shall seem meett and how you shall Execute this Writt that you make Known unto Our Said Justices at the same day and place afd and have you then and there this Writt Wittness Charles Ballard Gent Chiefe Justice of Our Said Court the 3.d day of May in the Eighth Year of Our Dominion &c Ann Dom 1723 (G Dashiell) Thomas Hayward Clk Att which said third th tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Comes the said John Scarbrough by his attorney afd and the sherr of Sommersett County to whom the foregoeing Writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following vizt By vertue of the Within Writt to me directed I have attached in the hands of the severall persons in a shedule to this writt annexed as the goods and Chattles of the Within Named William Gilchrist I have made Known unto the severall persons that they be and appear before the Justices Within Mentioned at the day and place within Contained to shew Cause if any they have why the said severall sums of Money so attached in the hands of as the goods and Chattles of the afd William Gilchrist should not be Condemned and Execution thereof made before John Doe and Richard Roe good and Lawfull men of my Bailiwick as by the Within Writt I am Commanded so answereth Jos: MccChester sherr In the hands of Daniel Cordery 3..0..0d In the hands of Somrsett Dickenson 12..6 In the hands of Charles ramsay 1..3..1½ Whereupon the said Daniel Cordery Garnishee ^as afd^ in his Own proper person appears and voluntarily with Consent of the plfts attorney takes his Oath that he hath none of the rights and Creditts of the said Defts in his hands thereupon the said Daniel Cordery is discharged Likewise the afd Somrsett Dickenson ^Garnishee as afd^ altho' solemnly Called Comes not nor shews Cause whey &c but makes default whereby the said plft remains thereof wholy undefended &c Whereupon the said Charles Ramsay Garnishee of the afd William Gilchrist appears in his Own proper person and says that he Cannot gainsay that he has of the rights and Creditts of the said William Gilchrist to the value of Nine shillings and two pence nor but that the same Ought to be Condemned in his hands for the use of the said John Scarbrough as of the rights and Creditts of the said William Gilchrist which the said plft does not gainsay Whereupon the said John Scarbrouth by his attorney afd ^prays^ that the sums ^so as^ afd Confesed by the said Somrsett Di Charles ramsey and attached in the hands of the said Somersett Dickenson as of the rights and Creditts of the said William Gilchrist may be Condemned in the hands of the said Charles ramsey & Somrsett (Dickenson) |
