67 appears and in his Own proper person and says that he Cannot gainsay but that he has of the rights and Creditts of the Said Thomas Drummond and Mary his wife to the value of one thousand one hundred seventy seven pounds of tobo ^so as afd attached^ nor but the same Ought to be Condemned in his hands for his own proper use as the rights and Creditts of the said Tho.s Drummond and Mary his wife &c But the said Bennony Edwards Garnishe as afd altho' Solemnly Called Comes not nor shews Cause why &c but makes default whereby the said Plft remains thereof wholy undefended Whereupon the said John Dennis in his one proper person prays that the said sum afd of Tobo and mony as of the rights and Creditts of the said Thomas Drummond and Mary his wife may be Condemned in the hands of the said John Dennis and Benony Edwards towards satisfying unto the said John Dennis as well the sum of one thousand one hundred and fifty two pounds of tobo as also the Costs ensueing upon the Writt of attachm.t afd Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom one thousand seven hundred and twenty three that the said sum of One thousand One hundred seventy seven pounds of tobo so as afd attached and Confesed be Condemned in the hands of the said John Dennis as of the rights and Creditts of the said Thomas Drummond and Mary his wife towards satisfying unto the said John Dennis as well the sum of One thousand One hundred & fifty two pounds of tobo as also the Costs accrueing upon the Writt of attachm.t afd and that thereof he have his Execution according to act of assembly &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said sum of forty shillings so as afd attached be Condemned in the hands of the said Benony Edwards as of the rights and Creditts of the said Thomas Drummond and Mary his wife towards satisfying unto the Said John Dennis as well the sum of one thousand one hundred and fifty two pounds of tobo as also the Costs accrueing upon the Writt of attachment afd and that the said John Dennis have thereof his Execution against the said Benony Edwards according to act of assembly &c
all hollows parish in Sommersett County Merchant ^of they shall be found in your Bailiwick) to the value of three pounds Currt mony and four hundred pounds of tob.o and when you have the same attached or any part thereof the same in your Custody safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek in Sommersett County afd the third tuesday of June next then and there to be Condemned according to act of assembly to and for the use of a Certain John Scarbrough unless the said William GildChrist by himself or his attorney shall appear and answer unto the said John Scarbrough in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men of your Bailiwick you make Known unto the person or persons in whose hands you make the same attachment (that) |
