1723 67 satisfying unto the said Nehemiah Mesick as well the sum of two pounds ten shillings and three hundred pounds of tobo as also ^the^ Costs accruing upon this Our Writt of attachm.t afd and that the said Nehemiah Mesick have his Execution thereof against the said Richard Wallice according to act of assembly &c
Thomas Drummond and Mary his wife if they shall be found in your Bailiwick to the value of fifteen hundred pounds of tobacco and when you have the same so attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of Our County County Court to be held at Dividing Creek in Sommersett County afd the third tuesday of June next then and there to be Condemned according to act of assembly to satisfie unto a Certain John Dennis Jun the sum of One thousand One hundred and fifty two pounds of tobacco which the said John Dennis was adjudged for his Costs and Charges by him about his defence in a Certain action of trespass upon the Case by the afd Thomas Drummond and mary his wife against the said John Dennis in Our Said Court before the Justices thereof on the thirtieth day of aprill last past Lately Brought Sustained according to the form of the Statute thereupon lately made and provided whereof the said Thomas Drummond & Mary his wife are Convict as appears upon records and also all Costs and Charges upon this Our Writt of attachmt and that by good and Lawfull men of your Bailiwick you made Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles rights or Creditts so attached in his her or their hands Ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and provided if to him her or them it shall seem mete and how you shall Execute this Writt Wittness Charles Ballard Gent Chiefe Justice of Our Said Court the 3d day of may in the Eighth year of Our Dominion &c Ann Dom 1723 Pse Thomas Hayward Clk Att which said third tuesday of June to witt the Eighteenth day of the same Month ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Comes the said John Dennis in his own proper person and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst viz.t By Vertue of the Within Writt to me directed to the Justices within Mentioned I have attached in the hands of John Dennis Jun to the value of One thousand ^One hundred seventy seven^ pounds of tobo and in the hands of Benony Edwards forty Shillings so answers Jos: MccChester Sherr Whereupon the Said John Dennis Jun Garnishee of the afd Thomas Drummond and Mary his wife (appears) |
