of Sommersett County Greeting Wee Command you that you attach any the goods Chattles rights or Creditts of Jonathan Thurston
late of Sommersett County if they shall be found in your Baliwick to the Value of two pounds ten shillings and three hundred
pounds of tobacco and when you have the same attached or any Part thereof the same in your Custody Safe Keep so that
you have the same before the Justices of Our County Court to be held at Dividing Creek the third tuesday of June next
then and there to be Condemned according to act of assembly to and for the Use of a Certain Nehemiah Mesick unless the
said Jonathan Thurston by himselfe or his attorney shall appear and answer unto the said Nehemiah Mesick in a plea
of trespass upon the Case &c  according to Law and that by good and Lawfull men of your Bailiwick you make Known
unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before
the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles rights
or Creditts in his her or their hands ought not to be Condemned and Execution thereof had and made according to the
form of the act of assembly in that Case made and provided if to him her or them it shall seem mete and how you
shall Execute this Writt that you make Known unto Our Said Justices at the day and place afd and have you
then and there this WRitt Wittness Charles Ballard Gent Chiefe Justice of Our Said Court the 23d day of march in
the Eighth Year of Our Dominion &c Ann Dom 1722        (G Dashiell)                                Thomas Hayward Clk

                 Att which said third tuesday of June to witt the Eighteenth day of the same month ann Dom One thousand
seven hundred and twenty three being the day of the return of the said Writt Comes the Said Nehemiah Mesick by his
attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and
makes return thereof to the Court here Endorst in these words vizt

                         By vertue of the Within Writt to me directed to the Justices Within Mentioned I have attached
in the hands of Richard Wallice and sumoned him as Garnishee the goods and Chattles of the Within Named Jona
Thurston three hundred and seventy ^two^ pounds of tobo  1..13..0 and thirty six Bushells and one peck of salt
3..12..6 as also One Pork Barrell 2/6 and I have make Known unto the Said Richard Wallice that he be &
appear before the Justices within Mentioned at the day and place within Contained to Shew Cause if any he have why
the said severall sums of money and tobacco so attached in his hands as the goods and Chattles of the afd Jonathan
Thurston should not be Condemned and Execution thereon made Before Jno Doe & Rich.d Roe good and Lawfull
men of my Bailiwick as by the Writt to me I am Commanded so answers   Jos MccChester Sherr

          Whereupon the said Richard Wallace altho' solemnly Called Comes not nor shews Cause why &c  but
makes default whereby the said Plft Remains thereof wholy undefended &c

                   Whereupon the said Nehemiah Mesick by his attorney afd prays that the severall goods and tobo
afd attached of the value of five pounds Eight shillings as of the rights and Creditts of the said Jonathan Thurston
may be Condemned in the hands of the said Richard Wallice towards satisfying unto the said Nehemiah Mesick as
well the sum of two pounds ten shillings and three hundred pounds of tobo as also the Costs accrueing upon the writt
of attachm.t afd                          Therefore it is Considered by the Justices here the Eighteenth day of June ann Dom
One thousand seven hundred and twenty three that the said sum of three hundred & seventy two pounds of tobo of the
value of one pound thirteen shillings; ^and^ thirty six Bushells & one peck of salt of the value of three pounds twelve shill
and six pence and one pork Barr.ll of the value of two shillings and six pence so as afd attached be Condemned
in the hands of the ^said^ Richard Wallice as of the rights and Creditts of the said Jonathan Thurston towards
