65 the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and provided if to him her or them it shall seem meett and how you shall Execute this writt that you make Known unto Our Said Justices at the day and place afd and have you then and there this Writt Wittness Charles Ballard Gent Chief Justice of Our Said Court the twenty fourth day of march in the Eighth Year of Our Dominion &c Ann Dom 1723 (F Allen) Thomas Hayward Clk Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Comes the Said Robert Martin by his attorney afd and the Sherriffe of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these Words Following viz.t By vertue of the WIthin Writt to me directed to the I have attached in the hands of the severall persons in a shedule to this writt annexed mentioned the severall sums of money to their severall Names annexed as the goods and Chattles of the Within Names William Gildchrist and Thomas Brown I have also made Known unto the said severall persons that they be and appear before the Justices within Mentioned to Shew Cause (if any they have) why the said severall sums of money so attached in their hands as the goods and Chattles of the afd William Gilchrist and Thomas Brown should not be Condemned and Execution thereof made before Jno Doe & rich.d Roe good and Lawfull men of my Baliwick as by the Within Writt I am Commanded so answers Jos: MccChester Sherr Attached in the hands of M.r William Whittington 1..15..9d Thomas Pointer 1..10..2d M.r Francis Allen 2..8..6 George Furniss 1..4..6 W.m Richardson 6/1 Edward Bennitt 3/7 W.m Hopkins 3/ W.m Pointer 1/6 And the said Francis Allen ^Garnishee as afd^ in his Own properson appears & Imparle hereunto till next Court &c Whereupon the said William Whittington, Thomas Pointer, George Furnace, W.m Richardson, Edw.d Bennett, William Hopkins and William Pointer Garnishees as afd altho' severally solemnly Called Come not noe Shew Cause why &c but makes default whereby the said Plfts Remains thereof wholly undefended &c Whereupon the said Robert Martin by his attorney afd prays that the severall sums of money afd so as afd attached as the rights and Credits of the said William Gildchrist and Thomas Brown may be Condemned in the hands of the said William Whittington Thomas Pointer, George Furnace, William Richardson Edward Bennett William Hopkins and William Pointer Garnishees as afd towards satisfaction of the said Robert Martin Damages and Costs afd &c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three that the said sum of One pound fifteen shillings and Nine pence so as afd attached be Condemned in the hands of the said William Whittington as of the rights and Creditts of the said William Gilchrist and Thomas Brown towards satisfying unto the said Robert Martin his damages and and Costs afd and that the said Robt Martin have his Execution thereof against the said William Whittington (according) |
