    June Court               1723                65
    Likewise Comes and makes return thereof to the Court here Endorst in these words following viz.t
                                                                                        Non Est Inventus P Jos: M.ccChester Sherr

             Whereupon the said Patrick Simpson by his attorney afd prays that for as much as he has Complyed
with the Law in Order to an attachment he may have Judgm.t against the Said Arthur Hayman for his damages
afd by way of attachm.t according to act of assembly &c    whereupon for that it seems to the Justices here
that the said Patrick Simpson has Complyed with the law as alledged

                                     Therefore it is Considered by the Justices here the Eighteenth day of June
Ann Dom One thousand seven hundred and twenty three afd that the said Patrick Simpson recover against
the said Arthur Hayman as well the sum of seven Pounds six shillings and Nine pence his
damages by Occasion of the Premisses afd as al Costs and Charges by the said Plft Laid Out and Expended
about his suite by way of attachm.t against the goods Chattles rights and Creditts of the said Arthur
(277)   Hayman according to act of assembly in such Case made and Provided &c

Memorandum the Plft Sued Out his Lordships writt of attachm.t against the

deft the tenor whereof followeth in these words vizt
                 Sommersett County fs.t Charles absolute Lord and proprietary
                                                          of the provinces of maryland and avalon Lord Baron of Baltemore &c To the sherr
    of Sommersett County Greeting Wee Command you that you attach any the goods Chattles rights or Creditts of William
    Gilchrist and Thomas Brown late of all hollows Parish in the County of Sommersett merchants if they shall
    be found in your Baliwick to the value of five pounds and Eight hundred pounds of tobacco and when you
    have the same so attached or any part thereof the same in your Custody safe Keep so that you have the
    same before the Justices of Our County Court to be held at Dividing Creek the third tuesday of June next then
    and there to be Condemned according to act of assembly to and for the use of a Certain Robert Martin unless
    the said William Gildchrist and Thomas Brown by themselves or their attorney shall appear and answer
    unto the said Robert Martin as appear and answer unto the Said Robert Martin in a plea of trespass upon
    the Case &c according to Law and that by good and Lawfull men of your Baliwick you made Known unto
