64 Otherwise Legally Cost that then the said Patrick Simpson shall pay the Condemnation of the Court thereupon and all Costs ensueing unto the said John Hitch and Mary Caldwell or that he the said Joseph MccChester will do it for him
held at Dividing Creek the third tuesday of June then next to answer unto Patrick Simpson of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Patrick Simpson by Francis Allen his attorney Proceeded against the said Arthur Hayman in the Plea afd as followeth vizt Sommersett County fst Arthur Hayman of Stepney Parish in the County of Sommersett planter was attached to answer unto Patrick Simpson of a plea of trespass upon the Case &c And whereupon the said Patrick by Francis Allen his attorney Complaines that whereas the afd Arthur the Twentieth day of November in the year of Our Lord God One thousand seven hundred and twenty two at Somrsett County and within the Jurisdiction of this Court was Indebted unto the afd Patrick in the sum of seven pounds six shillings and Nine pence to be paid in Part at the rate of twelve shillings and six pence p hundred as by a note by the said Arthur signed dated the day and year afd may in Court appear and so thereof being Indebted the afd Arthur afterwards to witt the same twentieth day of November in the year afd at the County afd and within the Jurisdiction afd in Consideration thereof did assume upon himselfe and unto the afd Patrick then and there faithfully did promise that he the afd Arthur the same seven pounds six shillings and Nine pence in Pork at twelve shillings and six pence p hundred unto the same Patrick when thereof afterwards he should be required unto the same well and faithfully would pay and Content Nevertheless the afd Patrick Arthur his Promise and assumption afd so as it is said made Nothing regarding but minding and fraudulently Intending the same Patrick in this part Craftily and Subtilly to deceive and defraud the afd seven pounds six shillings and Nine pence or any Part thereof unto the said Patrick hath not paid or in any sort Contented altho' to do the same the afd Arthur afterwards to Witt the afd twentieth day of November in the year of Our Lord God seventeen hundred and twenty of two afd and often afterwards at the County afd within the Jurisdiction afd by the afd Patrick he was required but that unto him hitherto to pay or any sort to Content altogether hath refused and still doth refuse to the damage of the said Patrick of fourteen pounds Curr.t money of this Province and thereupon he bringeth Suite &c Allen P Qrte Pledges deft Jno Doe R Roe A Copy of the foregoeing declaration was made and sent with the Writt in the Plea afd Att which said third tuesday of June to witt the Ninteenth day of the same month Ann Dom one thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the said Patrick Simpson by his attorney afd and the Sherr of Sommersett County afd to whom the foregoeing writt was Directed (Likewise) |
