64 hereunto untill the next Court and they have it and the same day is given to the Plft also Att which said next Court to witt the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three Comes again as well the said Edmond Hough by his attorney afd as the said Thomas Drummond and Mary his wife Executrix as afd by their attorney afd and the said Thomas Drummond and Mary his wife Executrix as afd by their said attorney as before defends the force and Injury when &c and say that the afd Edmond his action afd thereupon against them the said Thomas and Mary to have and Maintain Ought not because they say that they have fully administred all and singular the goods and Chattles which were of the afd John at the time of his death and that they have not nor at ye Day of the Impetration of the Originall Writt of him the said Edmond to witt on ye day of Ann Dom nor at any time since had any goods ^or^ Chattles which were of the afd John at the time of his death in their hands to be administred ^with^ which the said Thomas and Mary ^the^ afd four hundred fifty two pounds of tobacco or any Part thereof to the said Edmond Could pay and this they are ready to verifie whereupon they pray Judgm.t if the said Edmond his action afd against them thereupon to have and maintaine Ought &c F Allen P Defdt bus Whereupon the afd Thomas Drummond and Mary his wife Executrix as afd by their said attorney Prays that ye said Edmond Hough to their writt Plea afd above Pleaded may Answer but the said Edward Hough altho' solemnly Called Comes not nor to the Plea of the said Thomas Drummond and Mary his wife Executrix as afd Answereth nor is his writt and declaration against the same defts further Prosecuted &c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said Edmond Hough take nothing by his writt and declaration afd. But that he and his Pledges of Prosecuting be that is John Doe and Richard Roe be in mercy &c and the afd Thomas Drummond and Mary his wife Executrix of the afd John Griffin goe thereof without day &c And further it is Considered that the said Thomas Drummond and Mary his wife Executrix as afd recover against the said Edmond Hough the sum of Two hundred & Twenty six (226) pounds of tobacco by the Court here adjudged unto them for their Costs and Charges by them about their Suite defence afd in that part sustained according to the form of the statute in such Cases Lately made and Provided and that the same defts have thereof their Execut.n &c
Patrick Simpson may give security for Costs in Case Nonsuite be Obtained against him or the attachmts afd Thereupon a Certain Joseph MccChester of Sommersett County Gent Present herein Court undertakes for the said Patrick Simpson that in Case he be nonmuted on the attachmts afd or (otherwise) |
