       Robert being Indebted as afd for and in Consideration afd at the time and Place afd did upon himselfe assume
       and to the said Thomas then and there did faithfully Promise that the afd sum of six hundred and sixty^teen^ pounds
       of tobo he would well and truely Pay and Content when he should be thereunto requested Nevertheless the said
       Robert his Promise and assumption afd in form afd made little regarding but Contriveing him the said Thomas
       in that Part to deceive and defraud the afd six hundred and sixteen pounds of tobacco he hath not paid altho'
       Often thereunto requested but the same to pay hath refused and still doth refuse to the damage of the said
       Thomas of twelve hundred and thirty two pounds tobacco and thereupon he Brings this Suite

             Att which said third tuesday of June Ann.o to witt the Eighteenth day of the same month Ann Dom One thousand
       seven hundred and twenty three Being the day of the return of the said Writt Comes the said Thomas
       Dashiell by his attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed ^likewise^
       Comes and makes return thereof to the Court here Endorst in these words viz.t Non Est Inventus Short not Left P

                         Whereupon the said Thomas Dashiell by his attorney afd Prays that for as much as he has Complyed
       with ye Law in Order to an attachm.t he may have Judgm.t against the said Robert Perry for his damages afd
       by way of attachment according to act of assembly &.c   Whereupon for that it seems to the Court here that the
       said Thomas Dashiell has Complyed with the Law as alledged;
                                                                                                                           Therefore it is Considered by the
       Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three that the Said Thomas
       Dashiell Recover against the Said Robert Perry as well the sum of six hundred and sixteen pounds of tobo
       his damages by Occasion of the Premisses afd as all Costs and Charges by the said Plft Laid Out and Expended
       about his suite by way of attachm.t against the goods Chattles ^Rights^ and Creditts of the Said Robert Perry according
       to ye act of assembly in Such Case made and Provided &.c
