56 and Bring into Court here the severall Letters Testamentary afd by which &.c F Allen P Qrtbus Pledgs deft: Jno Doe & rich.d Roe Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt of Come the said Plfts by their attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes Return thereof to the Court here Endorst in these words viz.t Cepi Corpus P Jos: MccChester Sherr Whereupon the said Philip Taylor being Called appears and ^thereupon^ at the Prayer of the Plfts by their attorney afd is adjudged to give Speciall Bail to the action afd Thereupon a Certain Moses Tilman of Sommersett County Planter Present here in Court undertakes for the said Philip Taylor that In Case the said Plfts shall recover Judgm.t in the Plea afd against the said Philip Taylor or that the said Philip Taylor shall be therein Convict that then he the said Philip Taylor shall pay the Condemnation of the Court thereupon unto the Or Render his Body to ye Custody of the Sherr of Sommersett County in satisfaction thereof or that he the said Moses Tilman will do it for him Whereupon the said Philip Taylor Comes & defends the force and Injury when &.c And says that he Cannot gainsay the Plfts their action afd against them Brought nor Can he say but that the Writing Obligatory afd is his act and deed and that ye Debt therein mentioned is Yett due and Unsatisfied wherefore the said Plfts Prays Judgm.t for their Debt afd and their Costs and damages sustained by Occasion of ye Detaining the same debt to them to be adjudged &.c Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom: One thousand seven hundred and twenty three afd that the said William Whittington Southy Whittington Esther Skirvan and Hannah Whittington Ex.rs of William Whittington Esq.r lately decd who was Executor of ye Last will and testam.t of Stevens White gent dec.d Recover against the said Philip Taylor as well the sum of two Barrells of good sound merchantable Pork with Pickle and Every way well qualified and four pounds Curr.t silver mony of maryland then debt afd as also the sum of Two hundred (295) and Ninty five Pounds of tobacco by the Court here adjudged unto them for their Costs and damages sustained by Occasion of the detaining the same debt to them to be adjudged &.c and ye Deft in mercy &.c
Justices of the Peace the County Court of Sommersett to be held at Dividing Creek in Sum the third tuesday of June then next to answer unto Thomas Dashiell of a plea of trespass upon the Case &.c and that thereof he should not fail &.c And whereupon the said Thomas p George Dashiell his attorney Complains that whereas the said Robert in the year of Our Lord God One thousand seven hundred and twenty three at ye Parish and and sixteen pounds of tobacco as P.r account hereunto annext may in Court appear and the said (Robt) |
