of his Lordships County Court of Sommersett ^at Dividing Creek^ the third tuesday of June then next to answer unto Thomas Drummond and Mary his wife adm.x of the good and Chattles of John Griffith who died Intestate of a pea that he render unto them fifteen hundred pounds of tobacco which from them he unlawfully detains &.c and that thereof he should not fail &.c And whereupon the said Thomas and Mary by George Dashiell their attorney saith that whereas the afd Robert Pitts the Eleventh day of march One thousand seven hundred and Ninteen twenty at the Parish afd within the Jurisdiction of this Court by his Certain Bill which the said Thomas and Mary with the Seall of the said Robert signed hereinto Court Brings whose date is the day and year afd Bound himselfe to pay unto the afd John Griffin in his Lifetime his Ex.rs adm.rs &.c the afd sum of fifteen hundred pounds of tobacco upon the first day of December next Ensueing the date of the writeing afd Nevertheless the afd Robert altho' Often thereunto requested the afd sum of fifteen hundred pounds of tobacco or any Part thereof to the said John in his Lifetime or to the afd Mary after the death of the afd John Before Espousalls Between her and the afd Thomas Celebrated or to the afd Thomas and Mary since Espousalls between them Celebrated hath not rendered but the same or any Part thereof to them hitherto to render hath denyed and still doth deny to the damage of the said Thomas and Mary five hundred pounds of tob.o and thereof he Bring this Suite &.c G. Dashiell P Qert Pledges &.c Jno Doe & rich.d Roe Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the said Thomas Drummond and Mary his wife ^admn.x as afd^ by their attorney afd and the Sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words viz.t Non est Inventus Shorte note Left P Jos: MccChester sher Whereupon the said Thomas Drummond and Mary his wife adm.x as afd by their attorney afd Prays that for as much as they have Complyed with the Law in Order to an attachm.t they may have Judgmt against the said Robert Pitts for their Debt afd by way of attachment according to act of assembly &.c Whereupon for that it seems to the Court here that the said Thomas Drummond and Mary his wife adm.x as afd hath Comply with the Laws alledged; Therefore it is Considered by the Justices here the Eighteenth day of June Ann Dom One thousand seven hundred and twenty three afd that the said Thomas Drummond and Mary his wife adm.x as afd recover against the said Robert Pitts as well the sum of fifteen hundred pounds of tobacco their debt afd as all Costs and Damages by the said Plfts Laid out & Expended about their Suite by way of attachm.t against the goods Chattles and Creditts of the said Robert Pitts according to act of assembly in such Case made and Provided &.c |
