of five hundred and Eighty six pounds of tobacco and Costs of Suite against her which the said Plft
does not gainsay &c                         Therefore it is Considered by the Justices here the Eighteenth
day of June Ann Dom One thousand seven hundred and twenty three that the said Robert Martin
Recover against the said Naomi Shiles as well the sum of five hundred and Eighty six pounds of tob.o
(294)   Certain damages afd in form afd Confesed as also the sum of Two hundred and Ninty four
pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his Suite in this
Behalfe Laid Out and Expended and the deft in mercy &c

 Command was given to the sherr of Sommersett County that he should take Nathannel

Horsey of late of Coventry Parish in the County afd Gent if he should be found in his Baliwick
                                  and him should Safe Keep so that he might have his Body before the Justices of his Lordships
                County Court of Sommersett to be held at dividing the third tuesday of June then next to answer unto Betty
       Gale of a plea of trespass upon the Case &c and that thereof he should not fail &c
                                  And whereupon the said Betty Gale by Betty Gale Levin Gale her attorney Complains that whereas
the afd Nathaniell the tenth day of June One thousand seven hundred and twenty two at the Parish afd within
the Jurisdiction of this Court was Indebted unto the afd Betty the sum of three pounds Eighteen Shillings and
One Penny for goods and wares &c and so thereof Being Indebted the said Nathanell in Consideration thereof
the day and year af.d at the Parish afd within the afd Jurisdiction upon himselfe assumed and to the Said
Betty then and there faithfully Promised that he the Said Nathannell the afd sum of three pounds Eighteen
Shillings and One Penny to the afd Betty when afterwards he should be thereunto requested would well and
faithfully Content and pay Nevertheless the afd Nathannell his Promise and assumption afd in form afd made
Little regarding but Plotting and fraudulently Intending the Said Betty in that Part to defraud and deceive
ye afd sum of three pounds Eighteen Shillings and One Penny or any Part thereof altho' thereunto requested
the tenth day of may one thousand seven hundred and twenty three and often afterwards to the said Betty
hath not paid or Contented but the same hitherto to pay hath altogether refused and still doth refuse whereby
the said Betty says she is worse and hath damage to the value of seven pounds Curr.t mony and thereof
she brings this Suite &c             L Gale P Quer Pledges Jno Doe  R Roe
                      Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom one
thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the said Betty
Gale by Levin Gale her attorney and the Sherr of Sommersett County to whom the foregoeing Writt was
directed Likewise Comes and makes return thereof to the Court here Endorst in these words vizt

             Whereupon the said Nathannell Horsey in his Own Proper Person appears Comes and defends
the force and Injury when &c and says that he Cannot Gainsay the Plft her action afd so as afd against him
Brought nor Can he say But that the said Plft Ought to recover her damages by Occasion of the Premisses
