fail &c    And whereupon the same Robert by W.m Tazewell his attorney Complaines that the afd Naomi
the twenty second day of march ann Dom One thousand seven hundred and twenty two at Stepney Parish in the
County afd within the Jurisdiction of this Court was Indebted unto the afd Robert in the quantity of five hundred
pound and Eighty six pounds of tobo for sherr dues as by an acco.t thereof herewith in to Court Brought may
appear and Being so thereof Indebted she the same Naomi in Consideration thereof upon herselfe assumed and
to the same Robert then and there faithfully Promised that she the same Naomi the afd five hundred and Eighty
six pounds of tobacco unto the same Robert when she should be afterwards thereunto required would well and
truely Content and pay Nevertheless the afd Naomi her Promise and assumption afd in form afd made Little
regarding but minding and fraudulently Intending the afd Robert in this Part Craftilly and Subtilly to deceive
and defraud the afd five hundred and Eighty six pounds of tobacco or any Part thereof unto the same Robert
altho' the same Naomi by the Same Robert at the Parish and County afd within the afd Jurisdiction the three
and twentieth day of march ann Dom One thousand seven hundred and twenty two hath Been required
hath not Paid but the same to him hitherto to pay hath refused and still doth refuse to the damage
of the afd Robert Eleven hundred and seventy two pounds of tobacco and thereof he Brings suite &c

       Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand
seven hundred and twenty three Being the day of the Return of the said Writt Comes the Said Robert Martin
by his attorney afd and the Sherr of Sommersett County to whom the foregoeing Writt was directed Likewise
Comes and makes return thereof to the Court here Endorst in these words vizt Cepi  Answers Jos: MccChester Sher
                      Whereupon the said Naomie Shiles at the Prayer of the Plfts attorney afd is adjudged to give
Speciall Bail to the action afd thereupon a Certain Alice Shiles of Sommersett County Present herein Court undertakes
for the said Naomi Shiles that in Case the said Robert Martin shall recover Judgm.t in the Plea afd against
the said Naomi Shiles or that the said Naomi Shiles shall be therein Convict that then she the said Naomi Shiles
shall pay the Condemnation of the Court thereupon or render her Body to the Custody of the Sherr of Sommersett
County in satisfaction thereof or that she the said Alice Shiles will doe it for her
                      Whereupon the said Naomi Shiles by Levin Gale her attorney Comes and defends the force &
Injury when &c  and says that she Cannot gainsay the ^Plft his^ action afd so as afd against her Brought nor Can
she say but that the said Plft Ought to recover his damages by Occasion of the Premisses afd to the Sum
