49 here in Court acknowledged himselfe to Owe and stand Justly Indebted unto his Lordship the Lord Proprietary of this Province his heirs and successors in the sum of thirty Pounds Curr.t mony to be Levied on his Body goods or Chattles Lands or tennements to the use of his said Lordship the Lord Proprietarie In Case he does not Return the afd Mary Roberts to the Justices of his Lordships County Court of Sommersett to be held at Dividing Creek the third tuesday of March Next thereto be dealt with according to Law &c
she the said Rachell Walton saith Upshur King Foreman Thereupon Command was given to the Sherr of Sommersett County that he Should take the said Solomon Turpin of Stepney Parish if he should be found in his Baliwick and him should Safe Keep so that he might have his Body Before the Justices of his Lordships County Court of Sommersett to be held at dividing Creek the third tuesday of march then next to answer unto his Lordship Concerning a Certaine Presentment against him found and that thereof he should not fail &c Att which said third tuesday of march to witt the Nineteenth day of the same month Ann Dom One thousand seven seven hundred and twenty two Being ye Day of the return of the said Writt Comes the Sherr of Sommersett County to whom the foregoeing Writt was directed Comes and makes return thereof Endorst vizt Cepi Jos: MccChester Sherr Whereupon the said Sherr altho' solemnly Called to Bring in the Body of the said Solomon Turpin Comes not &c thereupon the said Sherr Humbly Prays the Court that day may be given him till next Court to Bring in the said Solomon Turpin to answer the Premisses afd &c which is to him Granted &c Att which said next Court to witt the Eighteenth day of June Ann Dom One thousand Seven hundred and twenty three Comes the Sherr of Sommersett County and Brings in the said Solomon Turpin to answer &c Whereupon the said Solomon Turpin Being sett to the Barr is thereupon Instantly demanded how he would acquitt himselfe of the Premisses afd saith that of the Premisses afd he is no wise guilty thereof and thereof for tryall putt himself upon the Country and W.m Tazewell who for his said Lordship in this part Prosecutes in Like manner Thereupon Command is given to the Sherr of Sommersett County that Immediately he Cause to Come here twelve &c by whom &c whom Neither &c to recognize &c Becaus as well &c of which said Preceipt the said sher to witt Joseph MccChester Gent makes return that he has here ready twelve &c as by his said Preceipt he was Commanded and the Jurors therein Impannelled being Called Came to witt Richard Holland, Thomas Collins, Mosses Driskell, Lazarus Maddux Manokin, John Fleming Price Collins, Ebenezer Handy, John Smith, Lazarus Maddux Pokamoke, Abraham Cowdery John Fountaine (Jonathan) |
