48 therefrom and Ordered to give New recognizance in the sum of five pounds Curr.t mony for her appearance at next November Court to be held at dividing Creek the third tuesday of Novem the same month to give Evidence on Behalfe of the Lord Proprietarie against Thomas Roucher Thereupon the said Esther Fluellin acknowledged herselfe to Owe and stand Justly Indebted unto his Lordship the Lord proprietarie of the province of Maryland his heirs and successors in the sum of five pounds Cur.t mony to be Levied on her Body goods or Chattles Lands or tenements for the use of his said Lordship In Case the said Esther Fluellin does not make her Personall appearance Before the Justices of his Lordships County Court of Sommersett to be held at dividing Creek the third tuesday of Novem next to give Evidence on Behalfe of the Lord proprietarie against the said Thomas Roucher and not to depart the same Court without Lycence thereof &c then the above recognizance to be void otherwise &c
Thereupon Command was given to the sherr of Sommersett County that he should take the said Mary Roberts of all hollows Parish in the County of Sommersett if she should be found in you his Baliwick & her should Safe Keep so that he might have her Body Before the Justices of his Lordships County Court of Sommersett to be held at Dividing Creek the third tuesday of March then next to answer unto his Lordship Concerning a Certain Presentm.t against her found &c and that thereof he should not fail &c Att which said third tuesday of march to witt the nineteenth day of the same month ann Dom One thousand Seven hundred and twenty three Being the day of the return of the said Writt Comes the sherr of Sommersett County to whom the foregoeing writt was directed and makes return thereof Endorst vizt Cepi P Joseph MccChester Sherr Whereupon the said Mary Roberts in her Own Proper person appears and being sett to the Barr is thereupon Instantly demanded how she would acquitt her Selfe of the Premises afd above Imposed upon her says that of the Premisses afd above Imposed upon her she is guilty thereof and submitts to the Mercy of the Court and makes Oath that her Master John Ricketts his Negro Man Called Simon is the Begetter of the Child she Now Stands Presented for Butt became the Justices here themselves will advise and Consider of and upon the Premises afd Before Judgm.t thereupon by them Compleated day is given unto the said Mary Roberts untill the next Court to here thereof their Judgm.t for that the same Justices here thereof are not as yett &c Att which said Next Court to witt the Eighteenth day of June Ann Dom One thousand seven Hundred and twenty three Comes againe the said Mary Roberts in her Proper person and forasmuch as the said Mary Roberts suffered herselfe to be Begott with Child by a negro Contrary to the Laws of this Province Its Ordered by the Court that the said Mary Roberts Return home with her Master John Ricketts and save him till march Court next which service is adjudged by the Court to be full satisfaction for the trouble Loss of time and Charge that the said John Ricketts was att att the time of her Child Bearing &c It is allso Ordered by the Court that the said John Ricketts give recognizance in thirty pounds Curr.t mony to return the said Mary Roberts to March Court Next &c Thereupon the said John Ricketts Present (here) |
