48 have her Body Before the Justices of his Lordships County Court of Sommersett to be held at Dividing Creek the third tuesday of June then next to answer unto his Lordship Concerning a Certain Presentm.t against thi her found and that thereof he should not fail &c Att which said third tuesday of June to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the Sherr of Sommersett County to whom the foregoeing Writt was directed Comes and makes return thereof Endorst viz.t Cepi Corpus Joseph MccChester Sherr Whereupon the said Mary Osten in her Own Proper person appears and being sett to the Barr is thereupon Instantly demanded how She would acquitt herselfe of the Premisses afd above Imposed upon her says that of the premisses afd above Imposed upon her says she is guilty thereof and submitts to the Mercy of the Court and makes Oath that a Certain Bryan Magrow is the Begetter of the Child she stands Presented for And is willing to pay her fine for the fact afd Wherefore it is Considered by the Justices here that the said Mary Osten be fined to his Lordship the Lord Proprietary of this Province the sum of thirty shillings for the fact afd to be paid by Wm Stoughton Esqr thereupon the said Mary Osten is discharge she giving security for the severall officers fee due by action of the Premisses afd thereupon George Bozeman Son of John Bozman undertakes for the said Mary Osten to pay the severall Officers their fees due to them by occasion of the Premises afd &c
Thereupon Command was given to the sher of Sommersett County that he should take the Cause the said William Pepper of all hollows Parish to Come Before the Justices of his Lordships County Court of Sommersett to be held at Dividing Creek the third tuesday of June next to answer unto his Lordship Concerning a Certain Presentm.t against him found &c and that thereof he should not fail &c Att which said third tuesday of June next to witt the Eighteenth day of the same month Ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Comes the Sher of Sommersett County and makes return thereof Endorst vizt Cepi P Jos: McChester Sher Whereupon the afd William Pepper in his Own Proper Person appears and Being sett to ye Barr and the Presentm.t afd being to him read submitts thereto with a protestation of his Innocency Becaus he would not Plead with the right honourable the Lord Proprietary and thereof puts himselfe upon ye favour of ye Court &c Wherefore it is Considered by the Justices that the said William Pepper be fined the so his Lordship the Lord Proprietary of this Province the sum of five hundred pounds of tob.o for the fact afd thereupon the said W.m Pepper is discharged paying the fine afd and all the Officers fees that accrued by Action of the Premisses afd &c
