       thereto requested the said John to the said George the sum of two thousand and fifteen pounds
       of tobacco he hath not paid but the same to him hitherto to pay hath denied and still doth deny to
       the damage of the said George four thousand fifteen pounds of tobacco and thereupon he brings
       his Suite         Dashiell P Quete Pledges   Jno Doe & Richd Roe

Errors Excepted P Geor: Hutchins

          Att which said third tuesday of march to witt the Nineteenth day of the same Month Ann Dom one
thousand seven hundred and thr twenty two being the day of the return of the said Writt Comes the said
George Hutchins by his attorney afd and the sherr of Sommersett County to whom the foregoing writt was
directed Likewise Comes and makes return thereof to the Court here Endorst in these words following vizt

             Whereupon the Court Adjourns untill the Last tuesday of Aprill next being the thirtieth day of
the same month Ann Dom one thousand seven hundred and twenty three on which day and year afd Comes
againe the said George Hutchins by his attorney afd.  And thereupon the said John Layton in his Own
Proper person Comes and defends the force and Injury when &c and says that he cannot gainsay
the Plft his action afd so as afd against him brought nor Can he Say but that the said plft but
Ought to recover his damages by Occasion of the premises afd to the sum of two thousand
and fifteen pounds of tobacco and Costs of Suite against him which the said Plft does
not gainsay &c
   
                                                                                  Therefore it is Considered by the Justices
here the thirtieth day of Aprill ann Dom One thousand seven hundred and twenty
three that the said George Hutchins Recover against the Said John Layton as well
the sum of two thousand and fifteen pounds of tobo and Certain damages afd in four
Costs   afd Confesed as also the Sum of three hundred and thirty Seven
(337)                           pounds of tobacco by the Court here adjudged unto him for
his Costs and Charges by him about his Suite in this Behalfe Laid Out and
Expended and the Deft in Mercy &c
