41 Maryland as p.r a note under the hand of the said Thomas may in Court appear and being Indebted as afd for and in Consideration afd at the time and Place afd did upon himselfe assume and to the said Benj.a then and there faithfully Promise that the afd four pounds fourteen shillings he would sell and truely Pay and Content Nevertheless the said Thomas his Promise and assumption afd in form afd made Little regarding but Contriveing him the said Benj.a in that Part to deceive and defraud the said sum of four pounds fourteen shillings he hath not Paid but the same to pay hath denyed and still doth deny to the damage of the said Benj.a of Nine pounds Eight shillings Currant mony and thereupon he Brings this Suite Dashiell P Qurte Pledges &c Jno Doe Rich.d Roe Att which said third tuesday of march to witt the Nineteenth day of the same Month ann Dom One thousand seven hundred and twenty two being the day of the return of the said writt Comes the said Benj.a Cottman by his attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst N E P Jos: Mcc.Chester Sherr Whereupon the Court adjourns untill the Last tuesday of aprill next being thirtieth day of the same month Ann Dom One thousand seven hundred and twenty three on which day and year Comes againe the said Benj.a Cottman by his attorney afd And thereupon the said Benja Cottman by his said attorney Prays that forasmuch as he has Complyed with the Law in Order to an attachm.t according to act of assembly &c whereupon for that it seems to the Court here that the said Benj.a Cottman has Complyed with the Laws as alledged Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three afd that the said Benj.a Cottman recover against the said Thomas Maddocks as well the sum of four pounds fourteen shillings Curr.t mony of Maryland his damages by occasion of the Premises afd as all Costs and Charges by the said Plft Laid Out and Expended about his suite by way of attachm.t against the goods Chattles ^rights^ or Creditts of the said Thomas Maddocks according to act of assembly in such Case made and Provided &c
next to Answer unto George Hutchins of a plea of trespass upon the Case &c and that thereof he should not faile &c And whereupon the said George P Dashiell his attorney Complains that whereas the said John in the year of Our Lord God One thousand seven hundred and twenty at the Parish and County afd within the Jurisdiction of this Court was Indebted unto the said George in the sum of two thousand and fifteen pounds of tobacco as P account hereunto an next may in Court appear and the said John Being Indebted as afd for and in Consideration afd at the time and place afd did upon himselfe assume and to the said George then and there did faithfully promise that the afd sum of two thousand and fifteen pounds of tobacco he would well and truely Content and pay when he should be thereunto requested requested Nevertheless the said John his promise and assumption afd in form afd made Little Regarding but Contriving him the said George in that Part to deceive and defraud (altho' often (thereto) |
