(41) And subtilly to deceive and defraud the spoons afd altho' often thereunto requested to the said Alexander hath not delivered but the spoons afd afterwards to witt the seventeenth day of November Ann Dom One thousand seven hundred and twenty two at the Parish and County afd within the Jurisdiction afd to his Own Proper use did Convert and dispose whereupon the said Alexander saith he is worse and hath damage to the value of twelve pounds mony afd and there upon he Brings suite &c Allen P Qrte Pledges deft Jno Doe Richd Roe And thereupon the said John Jones by Levin Gale his attorney Comes and defends the force and Injury when &c and Prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to ye Plft also Att which said next Court to witt the Nineteenth day of march Ann Dom one thousand seven hundred and twenty two Comes again as well the said Plft by his attorney ^afd^ as the said deft by his attorney afd And thereupon the Court adjourns untill the Last tuesday of Aprill next Ann Dom One thousand seven hundred and twenty three on which day and year Last mentioned Comes and again the said Partys Plft and deft by their attorneys afd and the said deft by his said attorney as before defends the force and Injury when &c and says he is not guilty of the Premisses upon him Imposed in manner and form as the afd Alexander hath above against him Complained and of this he Putts himself upon the County &c L Gale Whereupon the said Alexander Carlyle altho's solemnly Called to answer the Plea of the afd John Jones above Pleaded Comes not nor is his Bill in the Plea afd further Prosecuted against the said John Jones Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three afd that the said Alexander Carlyle and his Pledges in Prosecuting be in mercy &c and lett the Names of his said Pledges be sought for &c and that the said John Jones goe thereof without day And Likewise it is Considered by the Justices here that the said John Jones recover against the said Alexander Carlyle the sum of Two hundred and Sixty four (264) pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Part sustained according to the form of the statute and that thereof he have his Execution &c
in Somrsett County afd the third tuesday of March then next to answer unto Benj.a Cottman of a plea of trespass upon the Case &c And that thereof he should not fail &c And whereupon the said Benj.a p.r George Dashiell his attorney Complains that the said Thomas the fifth day of September Ann Dom One thousand seven hundred and twenty at Barbados viz.t at Stepney Parish in Somrsett County within the Jurisdiction of this Court was Indebted unto him the Just sum of four pounds fourteen shillings Curr.t mony of (Maryland) |
