1723 40 is given to the Plft also Att which said next Court to witt the Nineteenth day of March Ann Dom One thousand seven hundred and twenty two Comes again as well the said Plft by his attorney afd as the said deft by his attorney afd and thereupon the Court adjourns untill the Last tuesday of Aprill next being the thirtieth day of the same month Ann Dom One thousand seven hundred and twenty three ^on which day and year last mentioned^ Comes againe the said said Parties by their attorneys afd and the said deft by his said attorney Comes as before and defends the force and Injury when &c and says that the afd Alexander his action afd against him to have and maintain ought not because he says that after the time in which twas supposed he was received &c of the afd Alexander that is to say the twentieth day of may One thousand seven hundred and twenty two at Stepney Parish in Somrsett County did fully acco.t with the afd Alexander for the Porke afd in the Bill of the afd Alexander Mentioned and this he is ready to veryfie whereof he demands Judgm.t whether the afd Alexand his action afd against him to have and maintain ought &c L Gale P Defte Whereupon the said Alexander Carlyle altho' solemnly Called to answer the Plea of the afd Charles Ballard above in Barr Pleaded Comes not But makes default nor is his Bill in the Plea afd further Prosecuted against him the said Charles &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Alexander Carlyle and his Pledges in Prosecuting be in mercy &c and lett ye Names of his said Pledgs be sought for &c and that he the said Alexander Carlyle Charles Ballard goe thereof without day and Likewise it is Considered by the Justices here that the said Charles Ballard Cost (288) recover against the said Alexander Carlyle the sum of Two hundred & Eighty Eight Pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite defence in this Part sustained according to the form of the statute and that thereof he have his Execution &c
Lord Proprietary of the Court here Present herein Court in his own Proper Person of a plea of trespass upon upon the Case &c the tenor of which Bill follows in these words to the Justices of the right honrble the Lord Proprietary of the County Court here now held for the County of Somrsett Somrsett County ss.t Alexander Carlyle by Francis Allen his attorney Complains against John Jones Gent One of the Justices of the County Court of the right honrble the Lord Proprietary Present herein Court in his Own Proper Person of a plea of trespass upon the Case &c for that whereas the said Alexander the thirtieth day of aprill Ann Dom One thousand seven hundred and three at Stepney Parish in the County of Somrsett afd within the Jurisdiction of this Court was Possesed of six silver spoons of the value of six pound Curr mony of maryland as of his Proper goods and Chattles and being so thereof Possesed the spoons afd out of his hands and Possession Causually Lost which said spoons afterwards to witt on the first day of aprill Ann Dom One thousand seven hundred and twenty at the Parish and County afd within the afd Jurisdiction to the hands and Possession of the said John Jones by finding Came Nevertheless the said John Jones well Knowing the spoons afd to be the Proper spoons of him the said Alexander and to him the said Alexander of right to belong and appertain Contriveing and fraudulently Intending the said Alexander of the spoons afd Craftilly (and) |
