36 that he the said William so much tobacco or Corn as the said John James for the said Cure should reasonably deserve to the said James when he should be afterwards thereunto requested he would well and faithfully Pray and Content and the said John in fact saith that altho' he giveing faith and Creditt to the Promise and Assumption of the afd William in form afd made afterwards to witt on the first day of September Ann Dom One thousand seven hundred and twenty two at Stepney Parish afd in the County and Jurisdiction afd did Cure the said of the ulcers afd and for that Cure did reasonable deserve to have seventeen hundred pounds of tobacco or seventeen barells of Indian Corn in Lieu thereof and thereof then and there gave gave Notice to the said William Nevertheless the said William his promise and assumption afd made Little regarding but Plotting and fraudulently Intending the said James in that Part Craftilly and subtilly to deceive and defraud the afd sixteen hundred pounds of tob.o or sixteen Barrells of Corn in Lieu thereof or any Part thereof to the said John hath not Paid as yett or him for the same in any wise Contented altho' the same to doe the said William afterwards to witt on the tenth day of September in the year One thousand seven hundred and twenty two afd and often afterwards at the Parish and County afd within the Jurisdiction afd by the said John ^James^ he was thereunto requested but the same to do hath altogether refused as yett doth refuse to the damage of the said John James of three thousand pounds of tobacco and thereof he Brings Suite &.c Allen P Qrte Pledg deft Jno Doe R Roe And the said William Shurman by George Dashiell his attorney Comes and defends the force and Injury when &.c and Prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft also Att which said next Court to witt the Nineteenth day of March Ann Dom one thousand seven hundred and twenty two Comes again as well the said Plft by his attorney afd as the said deft by his attorney afd and thereupon the Court adjourns untill the Last tuesday of aprill next being the thirtieth day of the same month Ann Dom one thousand seven hundred and twenty three on which day and year Last mentioned Comes again as well the said Parties by their attorneys afd and the said deft by his said attorney as before defends the force and Injury when &.c and saith that he did not upon himselfe assume in manner and form as the Plft in his declaration against him hath Complained and of this he pour puts himselfe himselfe upon ye Country Dashiell P Deft And ye Plft in Like manner Allen P Qrte But the said James Feillett altho's Solemnly Called Comes not nor is his writt in the Plea afd further Prosecuted against the said William Shurman Therefore it is Considered by the Justices here the thirtieth day of aprill Ann Dom One thousand seven hundred and twenty three afd that the said James Feillett and his Pledges in Prosecuting be in Mercy &.c and Lett the Names of the said Pledges he sought for &.c and that the said William Shurman go thereof without day And Likewise it is Considered by the Justices that the said William Shurman recover Cost (188) against the said James Feillett the sum of one hundred & Eighty Eight Pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in Behalfe Laid Out and Expended according to the form of the statute and that thereof he have his Execution against the said James Feillett &.c |
