                   Whereupon the said William Kanes in his Own Proper Person Comes and defends the
    force and Injury when &.c and says that he Cannot gainsay the Plft his action afd so as afd against
    him brought nor Can he say but that the Said plft Ought to recover his damages by Occasion by Occasion
    of the Premisses afd to Eight hundred and seventy Pounds of tobo and Costs of suite against him
    which ye said Plft does not gainsay
                                                                                              Therefore it is Considered by the
Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three that
the said Robert Martin Recover against the said William Kanes ^as well^ the Sum of Eight hundred and
seventy Pounds of tobo his damages afd in form afd Confesed as also the Sum of Two hundred & Twenty
(229)   Nine                                 pounds of tobo by the Court here adjudged unto him for his Costs and
Charges by him about his Suite in this Behalfe Laid Out and Expended and the Deft in Mercy &.c

Command was given to the sherr of Sommersett County that he should take
the George furnace late of All hollows Parish in the County of Sommersett
Taylor if he should be found in his Baliwick and him should Safe Keep so
          that he might have his Body before the Justices of his Lordships County Cort of Sommersett to be
       held at Dividing Creek the third tuesday of March then next to answer unto Robert Martin of a plea
       of trespass upon the Case &.c and that thereof he should not fail &.c
                      Att which said third tuesday of march to witt the Nineteenth day of the same month Ann Dom
       One thousand seven hundred and twenty two Being the day of the return of the said Writt Comes the said
       Robert Martin by francis Allen his attorney and the sherr of Sommersett County to whom the foregoeing
       writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words vizt
                                                                                                       Cepi P me   Joseph MccChester Sher
                      thereupon the said George furnace being Called appears and thereupon the said George furnace
       At the prayer of ye Plfts attorney afd is adjudged to give Speciall Bail to the act afd but for want
       thereof the said George furnace is Committed into the Custody of the Sherr of Sommersett County there
       to remain &.c the said sherr being Present here in Court took Charge of the said George furnace accordingly
                         thereupon the said George furnace in Custody as afd by George Dashiell attorney Comes &
       Prays that he may in favour of Liberty he may have a tryall in Custody which is granted him & d the
                   Whereupon the said Robert Martin Proceeded against the said George Furnace in Custody as afd in
       the Plea afd as follows vizt                  Sommersett County st   George furnace late of allhollows Parish in the
       County of Sommersett Taylor was attached to answer unto Robert Martin of a plea of trespass upon the
       Case &.c And whereupon the said Robert Martin by the P by francis Allen his attorney Complains
       against that whereas the afd George the thirtieth day of November in the Year of Our Lord God One thousand
       seven hundred and twenty one at the afd Parish and County and within the Jurisdiction of this Court
       was Indebted unto the afd Robert in the sum of twenty four pounds six shillings and one halfe Penny
       Lawfull mony of America and seven hundred and twenty seventy pounds of tobacco as by an accot
