27 thereof to the Court here Endorst in these words viz.t Cepi Joseph MccChester sherr thereupon the Court adjourns untill the Last tuesday of Aprill being the thirtieth day of the same month Ann Dom Dom One thousand Seven hundred and twenty three at which day and year afd the Court sett againe & then and there Come the said George Goddard Etuxor Exr as afd by George Dashiel their attorney and defends the force and Injury when &.c and Offers themselves against the said Thomas Brereton in the plea afd but the said Thomas Brereton altho solemnly Called Comes not is his writt in the plea afd for them Prosecuted against them the said George Goddard Etuxor Exr as afd Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Thomas Brereton and his Pledges in Prosecuting be in mercy &.c and that the Names of the said Pledges be sought for &.c and that the said George Goddard Etuxor Ex.rs as afd goe thereof with out day and also it is Considered by the Justices here that the said George Goddard Etuxor Exrs as afd recover against the said Thomas Cost (153) Brereton the sum of One hundred & fifty Eight by the Court here adjudged unto them for their Costs and Charges by them in this Part ^about their defence pounds of tobacco^ Laid out and Expended according to the form of the Statute &.c
that whereas the said William the thirtieth day of November Ann Dom One thousand seven hundred and twenty two at the Parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robt in Eight hundred and seventy pounds of tobacco for Levies Sherr fees Publick dues and forbearance thereupon to the said Robert then and there due Oweing and unpaid as by an acco.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said William in Consideration thereof afterwards to witt the day and year afd at the place afd upon himselfe did assume and unto the said Robert then and there did faithfully Promise that he the said William the afd Eight hundred and seventy Pounds of tobacco to the said Robert when he should be afterwards thereunto requested he would well and faithfully pay & Content nevertheless the said William his Promise and assumption afd in form afd made Little regarding but Plotting and fraudulently Intending the said Robert in that Part Craftily and Subtilly to deceive and defraud the afd Eight hundred and seventy Pounds of tobacco to the said Robert he the hath not pair or to him for the same in any wise Contented altho' the same to doe the said William by the Said Robert on the first day of December in the year afd and often afterwards at the Parish and County afd with in the Jurisdiction afd he was thereunto requested but the same him to pay or in any wise to Content hath refused and still doth refuse and deny whereupon the Said Robert saith he is worse and hath damage to ye value of seventeen hundred and forty pounds of tobo & thereupon he Brings Suite &.c Allen PQ pledge deft Jno Do R Roe
