27 Pence Curr.t mony of maryland for One horse by the said John to the said George at the Especiall Instance and and request of the said George then and there at the Price afd sold and delivered and being so thereof Indebted the said George in Consideration thereof afterwards to witt the day and year afd at the Place afd within the Jurisdiction afd upon himselfe did assume and to the said John did then and there faithfully Promise that to the said George the said One thousand Pence to the said John when he should be afterwards thereunto requested he would well and faithfully Pray and Content And altho' the said George seventy Pence pcell of the said One thousand Pence to the said John he hath Paid and satisfyed yett as to nine hundred and thirty Pence residue of the afd One thousand pence the said George his Promise and assumption afd in form afd made nothing regarding but Plotting and fraudulently Intending the said John in that Part Craftely and subtilly to deceive and defraud the said Nine hundred and thirty Pence to the said John he hath not Paid or to him for the same in any wise Contented altho' the same to do the said George by the said John on the first day of august in the year afd and often afterwards at Snow hill town afd in the County afd within the Jurisdiction afd he was thereunto requested but the same to him hitherto to pay to pay or in any for the same to Content hath refused and still doth refuse and deny whereupon the said John Saith that he is worse and hath damage to the value of sixty pounds fifteen shill Curr.t mony of Maryland and thereupon he Brings Suite &.c Allen P Qrte Pledge p Jno Doe R Roe Whereupon the said George furnace by George Dashiel his attorney Comes and Defends the force and Injury when &.c and offers himself against the said John Pope in the plea afd but the said John Pope altho' solemnly Called Comes not nor is his writt in the Plea afd farther Prosecuted against the said George Furnace Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three that the said John Pope and his Pledges in Prosecuting be in mercy &.c and Lett the Names of the said Pledges be sought for &.c and that the Said George Furnace goe thereof without day and Likewise it is Considered by the Justices that the said George Furnace recover against the Said John Pope the sum of one hundred and forty seven (147) pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out and Expended according to the form of the Statute
of December Sommersett to be held at Dividing Creek the third tuesday of March then next to answer unto Thomas Brereton of a plea of trespass upon the Case &.c ^and that thereof he should not fail &.c Att which Said third tuesday of march to witt the Nineteenth day of the same month Ann Dom One thousand Seven hundred and twenty two being the day of the return of the said Writt Comes the said Thomas Brereton by Francis Allen his attorney and the Sherr of Somrsett County to whom the foregoeing writ was directed Likewise Comes and makes return thereof |
