273 bailywick and him should safe Keep so that he might have his Body before the Justices of his Lordships County Court of Somersett the third tuesday of march then next to answer unto Edmond Hough of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Edmond Hough by Francis Allen his attorney declared against the said John Hammond Hammon in the plea afd as followeth vizt Somersett County fs: John ^Hammon^ Late of Somersett County planter was attached to answer unto Edmond Hough of a plea of trespass upon the Case &c And whereupon the said Edmond by Francis Allen his attorney Complaines that whereas the said John the twentieth day of aprill seventeen hundred & twenty four at Somersett County afd within the Jurisdiction of this Court was Indebted unto the Said Edmond in three hundred & twenty pounds of good merchantable Pork as by a Certain Note by the said John signed dated the day and year afd may appear to be paid to the said Edmond by the said John at Snow hill Landing at or upon the tenth day of November then next Ensueing the date of the said Note and being so thereof Indebted the said John in Consideration thereof upon himselfe did assume and to the said Edmond then and there the day and year afd at the place afd did faith fully promise that he the Said John the said three hundred & twenty pounds of Pork to the said Edmond when he should be afterwards thereunto Requested he would well and faithfully pay and Content and whereas also the said John afterwards to witt the first day of October in the year afd at the County afd within the Jurisdiction afd was Indebted unto the Said Edm.d in Eighteen Shillings and Nine pence Curr.t money of maryland for Sundry goods wares & Merchandizes by the said Edmond to the said John at the Speciall Instance and Request of the said John before that time there sold and delivered and being so thereof Indebted the said John in Consideration thereof the afd first day of October in the year afd at the place afd within the Jurisdiction afd upon himselfe did assume and to the said Edmond then and there did faithfully promise that he the Said John the said EIghteen shillings and Nine pence to the Said Edmond when he should be thereunto Requested he would well and faithfully pay and Content Nevertheless the said John ^his severall^ promisses and assumptions afd in form afd made nothing Regarding but plotting and fraudulently Intending the said Edmond in that part Craftilly and Subtilly to deceive and defraud the said three hundred & twenty pounds of pork and Eighteen Shillings and Nine pence to the said Edmond according to his severall promisses and assumptions afd in hath not paid altho' to do the same by the said Edmond on the tenth day of Novem afd and often afterwards he was thereunto requested but the same to him hitherto to pay hath Refused and still doth Refuse and deny to the damage of the said Edmond of five pounds Curr.t money of maryland & thereupon he brings suite &c F Allen P Quer Pledges dep Jno Doe R Roe A Copy of the foregoeing declaration was made and sent to be served on the deft with the writt in the plea afd Att which said third tuesday of march to witt the sixteenth day of the Same (month) |
